국문 초록

Whether rebuttal evidence is permissible in the context of abstract endangerment offenses within the framework of risk criminal law in a risk society remains a highly debated issue in criminal law theory. This paper explores the indispensability and necessity of allowing rebuttal in abstract endangerment offenses from several dimensions: whether rebuttal should be permitted, counterarguments against rebuttal, and the specific implementation of rebuttal. The analysis proceeds from the dual perspectives of maintaining social order and safeguarding human rights, ultimately reaching a comprehensive conclusion that supports the necessity of rebuttal in abstract endangerment offenses.

영문 초록

风险社会语境下的风险刑法中的抽象危险犯是否允许反证，是刑法理论界争议较多的一个问题。本文从以下几个维度深入阐述抽象危险犯反证的不可或缺性，进而证明抽象危险犯反证存在之必要性。这几个维度分别为：是否允许抽象危险犯反证；反对抽象危险犯反证之反驳；抽象危险犯反证的具体实施。本文主要是从秩序的维护与人权的保障兼顾的情况下展开分析论证，从而综合考量得出结论。
