국문 초록

본 연구는 크루즈선에서의 가상자산 활용과 관련된 법적 관할권 문제를 기국주의와 항만국주의 관점에서 분석하였다. 크루즈선은 운항 중에는 주로 기국의 법률 적용을 받지만, 외국 항만에 입항하면 해당 항만국의 규제를 받으므로 두 관할권이 충돌할 수 있다. 선상에서 암호화폐와 같은 가상자산를 활용하는 새로운 시도가 증가함에 따라 현행 국제해양법 및 국내법 체계에는 이러한 사안을 명확히 규율하는 규정이 없어 법적 공백이 발생하고 있으며, 이로 인해 기국과 항만국 사이의 관할권 적용 범위에 대한 불확실성이 존재하는 실정이다. 따라서 크루즈선 내 암호화폐 거래에 대한 관할권의 범위와 한계를 명확히 하고, 기국과 항만국 간 협력 및 국제적 지침마련 등 법체계 정비가 필요한 것으로 판단되며, 관련 국제 협력을 강화할 필요가 있다.

영문 초록

This study examines the legal jurisdictional issues associated with the use of virtual assets on cruise ships, focusing on the interplay between the flag state principle and the port state principle. Cruise ships often operate under the laws of their flag state while on the high seas, but they also enter the territorial waters of various port states, which can impose their own regulations. The emergence of virtual assets like cryptocurrency use on board - for example, in onboard transactions or digital services - presents new regulatory challenges in determining which nation’s laws apply. Under international maritime law, the flag state generally has primary jurisdiction over vessels in international waters, yet port states retain certain jurisdictional rights when a ship is in port or in their territorial sea. This duality can lead to uncertainty and potential jurisdictional conflicts when novel activities like cryptocurrency transactions occur at sea. The analysis finds that current legal frameworks lack clear provisions for cryptocurrency use on cruise ships, resulting in gaps in oversight and enforcement. Based on these findings, the paper suggests that clarifications in law or new international guidelines may be necessary to address these gaps. Strengthening cooperation between flag states and port states is recommended to ensure effective regulation and legal certainty for cryptocurrency use at sea.
