국문 초록

본 연구는 2024년 비상계엄부터 시작해서 윤석열 탄핵 그리고 대선까지 이어지는 과정에서 한국의 헌정질서 파괴의 목격을 통해서 헌정질서 유지에 대한 신학적, 철학적 숙고의 필요성을 제기한다. 특히 윤석열 탄핵에 대한 개신교의 양분된 입장을 반성하며, 교회의 헌정질서 유지에 대한 신학적·철학적 입장을 서유럽의 역사적 맥락에서 고찰한다. 역사적으로 정치와 법은 밀접하게 연결되어 있다. 헌정질서의 유지에 대한 철학적 입장으로 칸트는 사회계약을 통해 수립되는 공화주의적 헌정질서를 옹호한다. 헌정질서는 이성의 공적인 사용, 즉 공론의 장에서 합의되고 논의된다. 헌정질서의 유지에 대한 신학적 측면에서 루터는 세속국가의 권리를 인정한다. 그러나 국가가 교회의 복음을 침해할 경우 비판하고 감시하는 역할을 감당해야 한다. 바르트는 교회와 국가는 예수 그리스도의 왕권 통치 아래에서 서로 다른 역할과 책임 속에서 유기적으로 연결됨을 직시하면서 국가가 정의와 평화를 유린할 때 침묵하지 않고 저항해야 한다고 주장한다. 신학적 입장을 고려할 때, 교회는 국가가 헌정질서를 유지하도록 협력해야 하며, 국가의 불의에 대해 능동적으로 예방하고 감시하며 비판하는 역할을 수행해야 한다.

영문 초록

This paper posits the necessity of theological and philosophical reflection on the maintenance of constitutional order, prompted by the observation of its disruption in Korea, spanning from the state of emergency in 2024 to the impeachment of Yoon Suk Yeol and the subsequent presidential election. It specifically critically examines the divided stance of Protestant Christianity regarding Yoon Suk Yeol’s impeachment and explores the theological and philosophical perspectives on the church’s role in upholding constitutional order within a Western European historical context. Historically, politics and law are intricately linked. Philosophically, Immanuel Kant advocates for a republican constitutional order established through a social contract. This constitutional order is sustained by the public use of reason, debated and agreed upon in the public sphere. From a theological standpoint, Martin Luther acknowledges the rights of the secular state. However, he posits that if the state infringes upon the Church’s gospel, the Church must criticize and monitor it. Karl Barth, recognizing the organic connection between Church and state under the kingdom of Jesus Christ argues that the Church must not remain silent but resist when the state violates justice and peace. Considering these theological perspectives, the Church should cooperate with the state in maintaining constitutional order. Furthermore, it must actively prevent, monitor, and critique state injustice.
