스토킹처벌법상 피해자보호조치의 현황 및 개선방안 - 긴급응급조치, 잠정조치를 중심으로

국문 초록

본 연구는 스토킹범죄의 특성과 그로 인한 피해자 보호의 필요성에 주목하여, 스토킹범죄의 처벌 등에 관한 법률상 긴급응급조치와 잠정조치의 운용 현황을 분석하고 개선방안을 제시하고자 하였다. 스토킹범죄의 처벌 등에 관한 법률은 2021년 제정 이후 피해자 보호를 위한 다양한 조치를 도입하였으나, 그 실효성에 대한 의문이 제기되어 왔다. 본 고는 하급심 판례 256건을 분석하여 긴급응급조치와 잠정조치의 위반 사례, 양형 경향 등을 실증적으로 검토하고자 하였다. 그 결과 잠정조치의 기간 제한, 긴급응급조치 및 잠정조치 위반 시 대응체계의 미비, 스토킹범죄 기소결정의 자의성, 스토킹범죄에 대한 완화된 처벌 등의 구체적 문제들을 확인하고, 긴급응급조치 불이행죄 및 잠정조치 불이행죄 법정형의 적정하지 못하다고 보았다. 이에 본 연구는 잠정조치 기간의 확보, 긴급응급조치 및 잠정조치 위반 시 유치조치 등 실질적 제재수단의 활용, 스토킹범죄와 긴급응급조치·잠정조치 불이행죄 간 처벌체계의 통합적 재구성 등 제도적 보완이 필요함을 제안하였다. 이러한 개선을 통해 스토킹범죄로부터 피해자를 실질적으로 보호할 수 있는 더욱 효과적인 대응체계를 마련하기를 기대한다.

영문 초록

This study focuses on the necessity of protecting victims of stalking crimes and analyzes the current implementation of emergency first aid about stalking behavior, emergency measure about stalking under the Stalking Crime Punishment Act. While the Act, enacted in 2021, introduced various protective mechanisms for victims, there are still concerns about their effectiveness. Based on an analysis of 256 trial cases, this paper identifies structural issues such as the limited duration of emergency measures, the lack of effective response systems in cases of violations, inconsistency in prosecution decisions for stalking crimes, and the lenient sentencing practices. The study also highlights the need to adjust the statutory penalties for violations of emergency first aid and emergency measures. Accordingly, it proposes institutional improvements such as securing sufficient duration for emergency measures, actively utilizing detention orders as a substantive response to violations, restructuring the punishment framework in an integrated manner for stalking crimes and violations of emergency and provisional protective measures. These improvements are expected to contribute to a more effective response system that ensures substantive protection for victims of stalking crimes.
