Based on Engels’ theory of the origin of the state, this paper analyzes the evolution of ancestral land governance (“zupu rights”) in Hong Kong’s New Territories, where kinship and material interests intertwine. The study reveals that traditional customary laws are not static in modern society but undergo adaptive transformations through dynamic adjustments. For example, the principle of “indivisibility of ancestral property” is pragmatically implemented through institutional arrangements such as the Pai Kei (ancestral revenue sharing system) and educational subsidies. These mechanisms construct a dual-layered governance structure characterized by “rigid principles and flexible implementation,” which ensures both the preservation of ancestral estates and the realization of individual rights within the clan. The study emphasizes that interest differentiation between household and clan structures requires a mediating force beyond society — the state. Judicial practices in the New Territories demonstrate that state governance plays a critical role in reconciling intra-clan conflicts and regulating traditional power structures.

本文基于恩格斯国家起源理论,剖析香港新界地区“祖权”治理在血缘与利益交织下的演变。研究指出,传统习惯法在现代社会中并非一成不变,而是通过动态调适实现适应性变迁。以“祖产不可分割”原则为例,其在实践中通过“派饥”分配、教育津贴等制度变通,构建起“刚性原则-柔性实施”的双层治理结构。这种结构既保障了祖产的传承与保全,又兼顾了家族成员个体权益的实现。研究强调,家户社会与氏族社会之间的利益分化需要国家这一凌驾于社会之上的力量加以调节,而香港新界的司法实践表明,国家治理在调和宗族利益冲突中发挥着关键作用。
