국문 초록

With the rapid development of the digital economy, data has become an important factor of production, and data disputes are increasing day by day. With the development of large-scale Internet enterprises, the trend of user concentration in the Internet market is becoming more and more obvious, coupled with the fact that China’s data ownership and data circulation rules are still insufficient in terms of justiciability and adjudication, resulting in the multiplication of the risk of monopolization of data by large-scale Internet enterprises. The theory of necessary facilities should be taken as a starting point, and the classification and grading system stipulated in “Twenty Articles on Data” should be combined to reshape the data monopoly regulation system in terms of determining the necessity of data sharing and clarifying the conditions of sharing, so as to enhance the systematization and applicability of the data anti-monopoly rules.

영문 초록

当前数字经济迅速发展，数据成为重要生产要素，数据纠纷与日俱增；随着大型互联网企业发展，互联网市场用户集中趋势明显，已呈现出垄断态势；数据需求方难以获取充足数据以实现算法迭代与产品更新，对市场经济起到妨害影响。本文从维护市场竞争有序开展角度出发，结合必需设施理论和我国现存规范制度，根据我国实践特色，探索在横向分类与纵向分级的横纵交互模式下，平台企业数据的强制共享机制，明确共享条件方面重塑数据垄断规制体系，增强数据反垄断规则的体系化和应用性。
