스토킹 범죄의 유형과 효과적인 대응방안

국문 초록

그동안 경미범죄로 취급하던 스토킹 범죄가 성폭력, 폭행, 살인 등 강력범죄로 확산되고 있는 추 세다. 이러한 스토킹 범죄는 강력사건 발생 이전의 전조 현상이라고 볼 수 있다. 이러한 우려 때문 에 2021년 3월 24일 최대 징역 5년까지 무겁게 처벌할 수 있는 「스토킹 범죄의 처벌 등에 관한 법 률」제정안이 22년 만에 국회를 통과하여 2021년 10월 21일 시행을 앞두고 있다. 스토킹 범죄는 경미한 범죄 행위로 시작하지만 성폭력, 사이버 스토킹 등 다양한 형태의 범죄로 변질될 가능성이 높다. 그러므로 규범적 연구 외에 사회적 원인 등 복합적인 요인을 철저히 분석해 서 실질적이고, 효과적인 대응책이 무엇인지를 모색해야 한다. 특히, 2021년 7월 1일부터 자치경찰제가 시행중이므로 스토킹 범죄에 대한 지방자치경찰과 국가수사경찰이 어떻게 대응해야 할 것인지, 각 시·군·구에서 운영 중인 자치단체와 어떻게 대응해야 할 것인지 등 다각적인 방안을 연구해야 한 다. 동시에 피해자에 대한 실질적인 보호대책 마련도 시급히 필요하다. 이에 본 연구에서는 일반적 스토킹 범죄와 사이버 스토킹 범죄를 구별하여 스토킹 범죄의 개념과 유형을 살펴보았으며, 가정폭력범죄, 성폭력범죄, 데이트 폭력 등 선행연구와 외국 사례를 비교, 검토하였다. 또한 경찰·검찰 등 수사기관, 병원 등 의료기관과의 지원 및 협력을 통해 스토킹 범죄를 예방하고 피해자에 대한 안전한 보호체계 마련 등 효과적인 대응방안을 제시하고자 한다.

영문 초록

Stalking, which has been treated as a minor crime, is spreading to violent crimes such as sexual violence, assault, and murder. These stalking crimes can be seen as a precursor to the violent incident. Because of these concerns, the enactment of the 「Act on the Punishment of Stalking Crimes」, which can severely punish up to 5 years in prison on March 24, 2021, passed the National Assembly for the first time in 22 years and is about to be implemented on October 21, 2021. Stalking crimes start as minor criminal acts, but are highly likely to degenerate into various types of crimes such as sexual violence and cyber stalking. Therefore, in addition to normative research, it is necessary to thoroughly analyze complex factors such as social causes to find practical and effective countermeasures. In particular, since the autonomous police system is in effect from July 1, 2021, how the local autonomous police and the national investigation police should respond to stalking crimes, how to respond with the local governments operating in each city, county, and gu, etc. A multi-faceted approach should be explored. At the same time, it is urgently necessary to prepare practical protection measures for victims. Therefore, in this study, the concept and types of stalking crimes were examined by distinguishing between general stalking crimes and cyberstalking crimes, and previous studies such as domestic violence crimes, sexual violence crimes, and dating violence were compared and reviewed with foreign cases. In addition, through support and cooperation with investigative agencies such as the police and prosecutors, and medical institutions such as hospitals, we intend to suggest effective countermeasures such as preventing stalking crimes and providing a safe protection system for victims.
