델파이(Delphi) 방법을 통한사법경찰관의 업무과중화 개선방안

국문 초록

우리나라는 개인 간 분쟁, 특히 민사 분쟁에 대한 피해가 발생하면 대부분 국민들은 112신고를 하거나 직접 경찰서에 고소·고발장을 접수하여 민원을 해결하려 한다. 이러한 고소·고발의 남용은 담당 경찰관의 업무과중화 및 불필요한 수사 인력 낭비를 초래하고 있다. 현재 고소·고발 업무를 전담하는 연구자는 이러한 현실에 대한 문제의식 하에 고소·고발 남용의 원인과 그 개선방안에 대한 연구를 시작하게 되었다. 이 연구는 부산지역 사법경찰관 중에서 고소·고발을 담당한 경찰관을 대상으로 델파이 설문조사를 진행하여 업무과중화를 개선하기 위한 방안을 고민해 보았다. 고소·고발 업무를 담당한 경찰관을 대상으로 총3회에 걸친 델파이 설문조사를 하여 업무과중에 대한 개선방안의 견해를 도출하였고, 그 결과를 세부적으로 살펴보면 다음과 같다. 우선, 대분류로 나눠보면 크게 ‘입법적 영역’, ‘제도적 영역’, ‘경제적 영역’, ‘사회적 영역’으로 구분할 수 있다, 입법적 영역에서는 ‘민사영역 처리 법률 보완’, ‘민사사건 접수배제 입법’, ‘무고죄 처벌 강화 또는 상습무고죄 입법화’ 등의 세부 개선요구 항목이 도출되었고, 제도적 영역에서는 ‘각하제도 간소화 및 각하처분 범위확대’, ‘사건배당 전 고소인의 수사대상자 검색 의무화’, ‘반려, 각하민원 사건에 대한 민원처리 전담관 지정 및 상담’ 등에 관한 세부 개선요구 사항이 도출되었다. 경제적 영역에서는 ‘고소 등 사건 접수비 부과’, ‘불기소 사건에 대한 고소인 등의 비용 부과’ 등의 세부 개선방안이 제시되었고, 마지막으로 사회적 영역에서는 ‘민사와 형사는 별개라는 인식개선’, ‘무분별한 고소 등에 대한 시민의식 함양 및 개선’ 등의 의견이 도출되었다. 이상에서 살펴본 바와 같이, 설문에 응답한 대부분의 사법경찰관은 고소·고발이 남용되고 있다고 인식하였고, 이로 인하여 업무가 과중되고 있으므로 그 개선방안에 대한 견해를 구체적으로 제시하였다. 이 연구에서 도출된 개선방안을 실현하기 위해서는 법률개정, 예산배정 등 해결해야 할 장애물이 산재해 있다. 이러한 개선방안의 실현은 업무를 담당하고 있는 사법경찰관을 위한 것뿐만 아니라, 국민의 인권을 위해서도 반드시 필요하다. 또한 이 연구 결과를 바탕으로 국민의 인권 향상은 물론이고, 사법경찰관이 더 효율적으로 업무를 수행할 수 있는 환경도 조성되어야 할 것이다.

영문 초록

In Korea, when there is damage to individual disputes, especially civil disputes, most people try to resolve the complaint by filing 112 or by filing written sues-accusations directly at the police station. The abuse of these sues-accusations leads to the overloading of the police officers in charge and the waste of unnecessary investigation personnel. Under this problematic reality, the researcher who is currently dedicated to the tasks of sues-accusations began to study the causes of abuse of sues-accusations and their improvement measures. This study conducted Delphi survey to investigate the cause and improvement (strategies) of abuse of sues-accusations on the subjects of the police officers responsible for sues-accusations among judicial police officers in Busan area. Delphi surveys were conducted for a total of three times for police officers in charge of the task of sues-accusations to derive opinions towards the causes of abuse of sues-accusations and the improvement (strategies). The results are to be summarized as follows. Most judicial police officers who responded to the survey recognized that sues-accusations are abused, and that because of this, the work is overloaded, so this study would provide implications on the improvement strategies. To realize the improvement measures derived from this study, there are scattered obstacles to solve such as legal amendment and budget allocation. The realization of these improvements is necessary not only for the judicial police officers in charge of the work but also for the human rights of the people. In addition, based on the results of this study, it is necessary to create an environment where judicial police officers can work more efficiently, as well as improve the human rights of the people.
