국문 초록

드론(Drone)의 비행은 원격조종장치에 의하거나, 입력된 프로그램에 의해 이루어지므로 조종자가 탑승하지 않는 무인항공기(UAV) 이다. 이와 같은 드론은 비행 목적에 따라 군사용, 취미·스포츠·오락용, 상업용 등으로 나누어지며, 성능과 기능의 고도화가 가속화되고 있다. 따라서 드론을 구입하게 되면 장치신고를 하도록 규정하고 있으며, 비행 전에는 국방부로부터 항공사진 촬영허가와 항공청으로부터 비행장치 비행승인 등을 받도록 되어 있다. 이와 같은 비행전 허가와 승인은 비행 안정성 확보를 위한 최소한의 가이드라인이므로, 이 속에는 비행승인 프로세스에 해당되는 비행장치에 대한 종류·형식, 용도, 소유자, 신고번호 등과 함께 비행 일시, 비행목적·방식, 경로·고도 등 비행계획 등이 포함되도록 규정하고 있다. 본 연구에서는 이와 같은 규정 준수를 공고히 하는 경찰 예방임무용 안티드론의 활용방안을 논의하기 위하여, 연구주제에 나타나 있는 임무의 명확화를 위하여 다음과 같이 정의하였다. 드론이 허가 받은 내용과 승인 받은 내용을 준수하면서 비행하면 ‘드론’으로 정의하였고, 비행승인 내용 중 한 가지라도 준수하지 않으면 ‘악의적 드론’으로 정의하였다. 이는 악의적 드론의 외관이 평범한 드론과 다를 바 없음을 의미한다. 단지 드론 조종자의 목적이 악의적이면 악의적 드론이 된다는 것이다. 악의적 드론 조종자들은 대부분 드론 응용분야의 고도화된 기술과 비행장치 및 기술의 고성능화에 관심이 많다. 이들은 고도화된 기술과 하늘을 비행하는 드론의 이점을 이용하여 국가 주요시설 위협, 사생활 침해, 개인정보 불법수집, 비행 불허 지역 침범, 마약 운반, 테러, 산업정보 스파이 행위 등을 목표로 비행 계획하므로 국민적 우려가 크다. 이와 같은 우려에서 한 걸음 더 나아가면 악의적 드론으로 인식·식별되었을 때 누가, 언제, 무엇으로, 어떻게, 악의적 드론의 비행을 멈추게 할 것인가에 대한 또 다른 우려가 있음을 알 수 있다. 지금 경찰은 악의적 드론의 비행을 멈춤 수 있는 도구와 수단을 가지고 있지 않기 때문이다. 따라서 본 연구에서는 악의적 드론 비행을 멈출 수 있는 경찰 예방임무용 안티드론 활용방안을 연구하는데 목적을 두고 있다. 본 연구를 통해 경찰이 드론 비행을 안전하게 관리 할 수 있음을 국민들에게 보여 줄 수 있을 것이기 때문이다. 이를 통해 본 연구는 기존의 경찰 임무용 드론 연구와 차별화하였다. 끝으로 본 연구에서는 악의적 드론 출현에 경찰권을 발동할 수 있도록 법제도 개선 필요성의 시사와 함께 이미 채택된 ISO 규정에 대한 경찰임무 중심의 대응자세도 담고 있다.

영문 초록

The Drone is an unmanned aerial vehicle (UAV) that the flight is controlled by an remote control device or by a pre-programmed flight computer. Drones have become specialized in function depending on its own purpose such as military, commerce, recreation or sports. Therefore, drones should be registered to government when it is purchased and must be approved for an aerial photograph from the Department of Defense and a flight permission for an Ultra Light Vehicle from the Regional Office of Aviation prior to flight. Pre-flight clearance and allowance by the government is a minimum guideline to ensure safety for the flight. A report for the Pre-flight clearance should include a type of flight object, usage, owner information, registered number and flight information including flight date, purpose of flight, flight altitude and course. As this study suggests usage measures of Anti Drone in a police prevention mission, the definition is as follows to clarify its mission. If the drone follows pre-flight clearance as it is reported and permitted by the government, it is defines as a ‘drone’. However, if it does not comply with at least one content in pre-flight clearance, it defines as a ‘malicious drone’. Therefore, there is no difference between drone and malicious drone in its appearance. Simply, the drone becomes malicious drone by a intention of a drone pilot. The most malicious drone pilots are interested in high performance of flight technology and up to date drone-related device. They use the advantage of drone that fly sky and threatens major facilities of nation and person’s life. In addition, they use it for invasion of privacy and illegal collection of personal information. The problem comes when the malicious drone is recognized and identified. Who, when and how the malicious drone should be stopped with what? At present, the police does not have measures to intercept malicious drones. As a result, this study is for usage measures of Anti Drone in a police prevention mission to stop flying of malicious drone. In addition, this study is differentiated from other police preventative mission drone study as the government can show the public that the flight of drones can be safely managed through this study. Finally, this study also suggests there is a necessity for an improvement of the legal system so that the police authority can be used against emergence of malicious drone.
