국문 초록

사회가 급변화, 세계화 되어감에 따라 우리나라의 외국인 유입이 증가되고 있다. 특히 농촌을 중심으로 동남아시아의 여성들이 결혼과 취업을 위해 들어오는 경우가 많다. 이렇듯 사회가 단일민족국가가 아닌 다문화 중심의 국가로 변하고 있으며 이에 따른 여러 가지 사회문제가 동반되고 있는 실정이다. 그 중 다문화가정의 가정폭력문제는 더 이상 개인의 일이 아닌 국가 즉 경찰기관이 개입해야 할 정도로 심각한 문제가 되었다. 따라서 경찰의 초기대응이 다문화 가정에서의 가정폭력을 예방하고 제2차 피해를 막을 수 있는 대안이라고 보여진다. 이를 위해 다문화가정의 폭력 실태와 심각성을 인식하고 일선 경찰이 현장에서 보다 적극적인 자세로 개입하는 것이 중요하다. 그러나 법제도적 측면에서 경찰의 가정폭력에 대한 개입 내용이 명확하지 않고 다문화 가정에 대한 선입견과 국적, 인종에 따른 편견이 결혼이주여성에 대한 가정폭력의 경찰 대응에 있어서 적극적 개입을 힘들게 하고 있는 실정이다. 이에 이 연구의 이론적 배경에서는 다문화가정의 의의와 특징을 알아보고, 가정폭력과 경찰대응에 관한 이론들을 살펴보았다. 이론적 배경을 토대로 다문화 가정에서의 폭력실태가 얼마나 심각한지를 사례분석을 통하여 그 문제점을 분석하였고, 그 문제점으로는 우선 정기적이고 전문적인 교육과 전담부서가 미비하고, 타 기관과의 연계가 부족하며 신고가 들어와도 경찰의 적극적인 해결의지가 부족한 것이 다문화가정의 가정폭력이 지속되게 만드는 원인이 되고 있다고 보여진다. 따라서 다문화가정의 가정폭력에 대한 경찰 대응에 있어서 여러 가지 법적·제도적 정비와 아울러 경찰관 및 일반인의 사회인식을 개선할 수 있는 교육 및 지속적인 홍보 등이 필요하다.

영문 초록

As the society becomes globalized, there is a growing influx of foreign workers and immigrant spouses from overseas into our country. Specially, the women of southeast Asia enter our country to get a job and get married. As result, as society is changing into multi-cultural countries, not a single ethnic country, various social problems have recently arisen . Among them, Domestic violence of Multi-cultural family becomes such a serious social problem, not individual, to the point that the police must be obliged to intervene with their problems. Therefore, the police's active steps are needed to prevent domestic violence of Multi-cultural family and their initiative actions are regarded as choices to stop the secondary victimization. Thus, we should recognize the seriousness of the violent situation and that it is important for the police to intervene with their problems actively. But in terms of legal system, the intervention of the police toward the family violence is not clearly identified and the prejudice of multi-cultural family and nationality and race prevent the police from taking actions in solving the family violence which immigrant women face. In conclusion, this study shows that the meanings and characteristic of multi-cultural family and theoretic surroundings on family violence and the police's response. Also, based on the surroundings of theory, we analyzed how serious domestic violence was through analysis of examples and recognized how imperative its solutions are. The solutions which this study shows to us are as followings. First, The police should take regular and professional education about domestic violence. Second, The special act regarding domestic violence is to be revised. With the upgraded legal basis, the capability that the police have in reacting domestic violences should be enhanced to arrest the attackers on the spot. Third, It is necessary that the police be connected with outside agencies to play their role properly. Therefore, in police's response toward violence of multi-cultural family, there are necessity of education and continual public relation and of strengthening the recognition of the police and individuals about family violence including setting up various legal and systematic revisions.
