The book “A Wild Justice : The Death And Resurrection Of Capital Punishment In America”, sorts out at length the efforts of The United States Supreme Court in the abolition of the death penalty in the 1970s in the form of nonfiction novel. The author holds the view that the failure of the abolition of the death penalty in the United States both can be related to the personal values of the justices(e. g.,the understanding of the status and function of the Supreme Court in the American political system) and can be influenced by some potential changes which were occurring in American society at that time. Above all, there are some fortuitous factors, but to some extent the failure was inevitability. The author’s making up of the story of the abolition of the death penalty based on the post-event perspective, to some extent, reveals the author’s understanding of the reasons for the failure of abolishing the death penalty in America. Also,This understanding reflects the explaining of the contemporary mainstream view in the United States for the failure of the abolition of the death penalty in many ways. That is to say ,Although the death penalty itself is a taboo in modern society, since the public can still accept the existence of the death penalty at this stage, the death penalty still plays an irreplaceable role in current American society. In other words, The contemporary death penalty system has both a certain degree of wild and a certain degree of justice. For the cultural elites,the former dominates in the characteristics of the death penalty, while in for the general public, especially the common people, the latter dominates in the characteristics of the death penalty. However, within the framework of the American democratic system, the cause of abolishing the death penalty which is led by the elite cannot bypass the votes of ordinary people. Only when ordinary people truly change their views on the death penalty, the death penalty can be truly abolished.
영문 초록
《野蛮的正义:美国死刑的死亡与复活》一书,以非虚构文学的形式,详细梳理了20 世纪70 年代美国联邦最高法院在废除死刑事业上所做的努力。作者认为,美国从司法上废除死刑的失败既与大法官个人的价值观有关,也与当时美国社会所发生的一些潜在变化有关。这其中既有一些偶然因素的影响,但也具有一定程度上的必然性。虽然死刑本身是现代社会的一种禁忌,但是民众在当前阶段仍然能够接受死刑的存在,死刑对当下美国社会仍具有不可替代的作用。换言之,当代死刑制度既具有一定的野蛮性,也具有一定的正义性。在文化精英看来,野蛮在死刑特质中占主导地位,而在普通公众特别是平民阶层看来,正义在死刑特质中占据主导地位。美国死刑存废之争,展现了精英与普通民众之间的价值沟壑。在美国式民主体制框架下,精英所主导的死刑废除事业不可能绕过普通民众的选票,只有普通民众真正转变死刑观念,才有可能真正废除死刑。
