국문 초록

본고는 챗GPT로 대변되는 생성형 인공지능의 관점에서 법률 자연어처리(Legal NLP)에 기반한 리걸테크(LegalTech)의 발전 과정과 도전 과제를 다룬다. 2017년 이후 트랜스포머 기반 언어 모델(BERT, GPT 등)의 등장으로 자연어처리 기술의 활용 범위가 크게 확장되었으며, 이는 단순히 언어 데이터를 처리하는 것을 넘어 다양한 응용 분야에 적용되고 있다. 이에 따라 최근 법률 데이터에 인공지능 기술을 적용하려는 시도도 활발하게 이루어지고 있다. 그러나 자연어처리는 시행착오를 거치며 발전하는 경험주의 학문이기 때문에, 법률 자연어처리 과정에서 여러 난관이 존재한다. 법률 데이터의 수집과 전처리 과정은 일반 텍스트와 비교할 때 상당히 복잡하며, 용어, 문체, 구문 처리 등에서 특유의 난해함이 있어 이를 학습 데이터로 변환하는 데 어려움이 따른다. 또한 법리 추론은 전문 법조인의 깊은 이해를 요구하는 영역으로, 현존하는 인공지능 모델로는 이를 완전히 구현하기 어렵다. 따라서 현재 인공지능의 추론 능력과 전문 법조인의 법리 추론 능력 사이에는 여전히 큰 차이가 존재하며, 생성형 인공지능이 법률 전문가를 완전히 대체할 가능성은 작다. 그러나 법률 데이터에 대한 체계적인 학습과 도메인 특화 모델 개발이 이루어진다면, 법률 업무를 보조하여 효율성을 높이는 데 중요한 역할을 할 수 있을 것이다. 법률 자연어처리 기술은 향후 법률시장에서 중요한 역할을 할 것으로 기대된다.

영문 초록

This study examines the development process and challenges of LegalTech based on Legal Natural Language Processing (Legal NLP) from the perspective of generative artificial intelligence represented by ChatGPT. Since the advent of transformer-based language models (e.g., BERT, GPT) in 2017, the scope of natural language processing technology has expanded significantly, extending beyond simple text processing to diverse applications. Consequently, efforts to apply AI technology to legal data have recently gained momentum. However, natural language processing, as an experiential discipline that evolves through trial and error, encounters numerous obstacles in the context of legal NLP. The collection and preprocessing of legal data are considerably more complex compared to general text, and unique challenges arise in terms of terminology, writing style, and syntax processing, making it difficult to transform such data into training sets. Furthermore, legal reasoning is a domain requiring the deep understanding of professional legal practitioners, which existing AI models are not yet fully capable of replicating. As a result, there remains a significant gap between the reasoning capabilities of current AI models and the legal reasoning abilities of experts, suggesting that generative AI is unlikely to completely replace legal professionals. Nevertheless, systematic learning of legal data and the development of domain-specific models could play a pivotal role in assisting legal tasks and improving efficiency. Legal NLP technology is expected to play a crucial role in the future legal market.
