국문 초록

인공지능 기술의 발전으로 법률가 직업군이 겪게 될 변화는 필연적이다. 하지만 기술의 발전을 통해 오히려 모든 법률가들에게 새로운 기회가 창출될 것이다. 그리고 기술적인 측면에 관심이 없는 법률가라도 오히려 법학적 사고와 논증방식에 더 매진하면 인공지능의 판단결과를 검증하는 역할을 수행할 수 있고, 이렇게 함으로써 기술 발전으로 인한 이익을 누릴 수 있다. 인공지능은 주로 빅데이터를 이용한 통계적 판단을 기초로 하는데, 법학에서 요구되는 것은 유사한 사안의 공통점과 차이점을 비교하여 해당사안을 해결하기 위해 필요한 유비추론 능력이기 때문이다. 법률가가 하는 업무에 디지털 기술이 도입되는 것은 경제적 비교형량을 통해 이루어질 것이다. 종래 사람이 하던 단순한 업무는 리걸테크를 통해 간소화하거나 효율적으로 처리할 수 있다. 다만 법률적인 판단력과 해석, 인간의 감정적 요소, 맥락적인 상황 판단, 윤리적 고려 등 인간만이 할 수 있는 역량은 현 시점에서 기계나 인공지능으로 완전히 대체될 수 없다. 그리고 법이 모든 상황을 정확하게 예측하고 구체적으로 다룰 수 없으므로 결국 인간의 판단은 여전히 의미가 있다. 그런 차원에서 법학교육 자체도 실무가를 양성할 때는 인공지능이 아직 쉽게 하지 못하는 인간적인 교류나 창의성, 판단력을 키우는 방향으로 육성하여야 한다. 그리고 법학을 공부할 때는 반드시 왜 그러한 결론이 내려졌는지에 대한 논거, 입법자는 왜 그렇게 입법하였으며 판사는 왜 그렇게 판단하였는지를 분석해야 한다. 인공지능을 넘어서는 근거를 생각하고 제시할 수 있는 능력을 기르는 것에 학습의 지향점을 두어야 한다. 인공지능을 활용하는 과정에서 기술적 지식이 유용하지만, 리걸테크를 활용하는 법률가가 되기 위해 반드시 필수적인 것은 아니라는 점이 중요하다. 다만 기술적 지식을 보유한 법률가가 더욱 고차원의 업무를 처리할 수 있을 것으로 기대될 것이다. 결국 미래의 법률가는 기술적 혁신에 적극적으로 대응하면서도 전통적인 법률가의 가치와 역할을 유지해 나가야 한다.

영문 초록

With the advancement of artificial intelligence technology, inevitable changes are bound to occur in the legal profession. However, through technological advancement, new opportunities will actually be created for all legal professionals. Even for lawyers who are not particularly interested in the technical aspects, focusing more on legal reasoning and argumentation can enable them to verify the judgments of artificial intelligence, and thus to get benefits from technological advancement. Artificial intelligence primarily relies on statistical judgments using big data, but what is required in law is the ability to engage in analogical reasoning by comparing the similarities and differences of other cases in order to resolve the issue at hand. The introduction of digital technology into the tasks performed by lawyers will be achieved through economic comparisons. Traditional tasks previously done by humans can be simplified or handled more efficiently through legal technology. However, capabilities such as legal judgment and interpretation, human emotional factors, contextual judgment, and ethical considerations —capabilities only humans possess— cannot be completely replaced by machines or artificial intelligence at the current stage. Additionally, since the law cannot accurately predict and address every situation, human judgment still holds significance. In that regard, legal education itself should focus on nurturing interpersonal interaction, creativity, and judgment —qualities that artificial intelligence still struggles to replicate— when training future practitioners. When studying law, it's crucial to analyze the reasons behind certain conclusions: why legislation was enacted in a certain way, why judges made specific judgments, and so on. Emphasizing the development of the ability to think beyond artificial intelligence and provide substantiated arguments should be the goal of legal education. While technical knowledge may be useful in the process of utilizing artificial intelligence, it's important to note that it's not necessarily essential for lawyers to become proficient in legal technology. However, lawyers with technical expertise are expected to handle more sophisticated tasks. Ultimately, future lawyers must actively adapt to technological innovations while maintaining the values and roles of traditional legal professionals.
