수도권 내 지자체의 공공기여 가이드라인 분석

국문 초록

본 연구는 개발사업 과정에서 실제로 적용되는 공공기여 기준을 검토하였다. 수도권 지방자치단체에서 조례 또는 지침으로 정한 공공기여 기준을 살펴보고 시사점을 제시하고자 하였다. 이에 연구는 공공기여와 관련된 조례와 문헌을 분석하고, 기존 연구 결과와 도시별 공공기여 가이드라인을 종합하여 시사점을 제시하였다. 수도권내 지자체들의 공공기여 기준을 종합해보면 다음과 같다. 서울과 인천시는 용도지역변경으로 인한 용적률 상승시 공공기여율을 60%로 적용하고 있지만, 경기도내 지자체들은 용도지역변경이 이루어지는 경우, 대부분이 50% 기준을 설정하고 있다. 다만, 지역별로 아파트를 비롯한 공동주택이 공급되는 경우나 지역별로 차이를 두어 적용하기도 한다. 이 연구는 수도권내 지자체의 공공기여 가이드라인 살펴보고 시사점을 확인하였다. 본 연구는 지역별로 설정한 공공기여 기준이 적절한지에 대한 판단에 제약이 따른다. 따라서, 가이드라인의 객관성을 판단하기 위해서는 향후 추가적인 연구가 이루어질 필요가 있음을 제안하였다.

영문 초록

1. CONTENTS (1) RESEARCH OBJECTIVES This study reviewed the standards of public contribution that are actually applied in the development project process. This study aims to examine the standards for public contribution set by local governments in the metropolitan area as ordinances or guidelines and present implications. (2) RESEARCH METHOD This study analyzed ordinances and literature related to public contribution. For each city, the definition of preliminary negotiation for urban planning change is similarly defined as the establishment of a development plan in consultation with the target site for the promotion of complex land use, efficient land development, and rationalization of land use through facility relocation and relocation. This study looked at the literature related to the guidelines for public contribution by city in the metropolitan area. The implications were presented by synthesizing the existing research results and guidelines for public contribution by city. (3) RESEARCH RESULTS According to the planning standards applied to the installation of public contribution facilities, facilities that are likely to be used as convenience facilities for tenants in the project site, facilities that must be installed under other related laws, and access roads to the project site are excluded or minimized. 2. RESULTS The criteria for public contribution are as follows. Seoul and Incheon apply the public contribution rate to 60% when the floor area ratio increases due to the change in the use area, but most local governments in Gyeonggi-do set the 50% standard when a change in the use area is made. In the case of urban planning facilities determination, abolition, and complexation, the calculation of public contributions is applied at 15%, and 20% is applied in some areas.
