국문 초록

연구목적: 본 연구는 장애학생 인권과 관련된 국내외 문헌을 종합적으로 검토하여, 장애학생 인권 보호의 현황과 주요 과제를 분석하고, 향후 인권 보호 및 교육 개선을 위한 정책적 시사점을 도출하는 데 목적이 있다. 연구방법: 본 연구는 장애학생 인권에 관한 국내외 법령, 정책 보고서, 학술 연구논문을 대상으로 문헌 분석을 실시하였다. 연구결과: 첫째, 장애학생 인권 보호를 위한 법적·제도적 기반은 마련되어 있으나, 교육현장에서의 실질적 이행은 여전히 미흡하였다. 둘째, 장애학생 인권침해는 다양한 형태로 발생하고 있어 예방 및 대응 체계 구축이 요구되었다. 셋째, 장애학생 인권교육은 형식적 수준에 머물러 있으며, 자기 옹호 역량을 강화하는 실천적 교육이 필요하였다. 넷째, 학교 내 지원체계 강화, 사회적 인식 개선, 통합교육 환경 내 인권 문화 조성 등 종합적 접근이 필요함이 제시되었다. 결론: 장애학생 인권 보호를 실질적으로 강화하기 위해 법·제도 개선, 교육 환경과 교사 연수의 내실화, 학교 내 지원체계 구축, 사회적 인식 개선 및 실천적 인권교육 강화를 위한 정책적 시사점을 제시하였다.

영문 초록

Purpose: This study aims to review domestic and international literature on the human rights of students with disabilities, analyze the current status and key challenges, and derive policy implications for improving rights protection and education. Method: A literature analysis was conducted using laws, policy reports, and academic studies related to the human rights of students with disabilities. Results: First, while legal and institutional frameworks exist, their implementation in schools is limited. Second, students face rights violations such as educational restrictions, discrimination, and violence, calling for preventive systems. Third, human rights education is often formal, highlighting the need for self-advocacy training. Fourth, a comprehensive approach is needed, including support system enhancement, awareness improvement, and fostering a rights-respecting school culture. Conclusion: This study reviews domestic and international literature on the human rights of students with disabilities, analyzes key challenges in rights protection, and proposes policy implications for future educational improvement.
