국문 초록

본 연구는 대한민국 민주주의의 핵심 주체인 정당 내부에서 당내민주주의가 제대로 작동하지 못하는 구조적 문제를 진단하고, 그로 인해 발생할 수 있는 헌정 위기의 가능성을 제기한다. 최근의 비상계엄령 논의, 대통령 탄핵 정국 등의 사례를 통해, 정당 내부의 비민주적 의사결정 구조가 국가적 혼란과 헌정질서를 위협할 수 있음을 지적한다. 이는 민주주의의 마지막 방어선이라 할 시민사회의 대응 역량을 약화시키는 요인으로도 작용한다. 오늘날 한국 정당은 선거보조금, 공천권, 정당 명부제 등 제도적 장치를 통해 국정 운영 전반에 깊숙이 관여하며, 정당 국가화 현상이 강화되고 있다. 그러나 제도적 권한의 확대와는 달리, 정당 내부의 민주주의는 정체되어 있으며, 이에 따라 정당민주주의의 후퇴, 공적 책임성의 약화, 국민 대표성의 훼손이라는 문제가 발생하고 있다. 이에 본 연구는 당내 의사결정 구조의 민주적 전환, 공직선거후보자 추천(공천) 과정의 공정성과 투명성 확보, 정당 재정의 민주화, 내부 권력 구조의 합리적 조정 등 구체적인 정당개혁 방안을 제시한다. 당내민주주의의 실현은 단순한 조직 운영의 효율성 문제가 아니라, 헌법이 정당에 부여한 책무이자 국민과의 약속이며, 민주주의와 헌정질서를 지탱하는 기둥이다. 정당은 정치적 권력의 독점이나 단기적 정치성과의 유혹을 경계하고, 헌법적 요청을 최우선의 기준으로 삼아야 한다. 본 연구가 제안하는 개혁을 통해, 정당이 민주주의의 진정한 수호자로 거듭나기를 기대한다.

영문 초록

This study examines structural deficiencies within South Korean political parties that hinder the realization of intra-party democracy. It argues that the lack of democratic decision-making processes contributes to political instability and poses a threat to con- stitutional order, as evidenced by recent events such as debates on emergency martial law and presidential impeachment. The weakening of democratic practices within parties also undermines civil society’s ability to safeguard fundamental freedoms and rights. These challenges are intensified by the rise of the Party State—a system in which political parties, heavily reliant on state funding and institutional authority, operate as extensions of the state apparatus. While this system can enhance stability and policy continuity, it reduces incentives for internal accountability and member participation, allowing centralized leadership to dominate without meaningful democratic oversight. To address these issues, this study proposes reforms aimed at democratizing internal decision-making, ensuring fairness and transparency in candidate selection, and enhancing democratic oversight of party finances. Intra-party democracy is not only a matter of organizational efficiency but a constitutional duty and a foundation of democratic governance. As parties take on quasi-governmental roles within the Party State framework, reinforcing democratic norms within them is essential to uphold the rule of law and revitalize democratic resilience in South Korea.
