국문 초록

China’s legal reform over the past decade has been massive and rich, affecting all areas related to the law, including courts, procuratorates, local governments, lawyers, and legal education. Lu Xu analyzes the progress of China's legal reform measures objectively and neutrally from an objective point of view, collecting a large amount of information, illustrating the facts with data, and presenting the appearance of the situation with the reactions of various sectors. China’s legal reform has brought a new vision to Chinese law in the past decade. In the face of the various achievements of China's legal reform, both domestic and foreign countries should maintain a positive attitude, evaluate the measures from a purely academic perspective, and look at the progress made by China in terms of actual results, including the decline in the arrest rate, the decline in the rate of felonies, and the rise in the overall standard of judges. A biased view would miss the many benefits of China’s legal reforms, which were also a core component of the rule of law.

영문 초록

中国在过去十年的法律改革规模浩大，内容丰富，这一改革影响了所有与法律相关的领域，包括法院、检察院、地方政府、律师和法学教育。徐露站在客观视角，通过收集大量资料，客观、中立地分析了中国法律改革各项措施取得的进展，用数据说明事实，用各界的反应展现表象。中国的法律改革，在过去的十年里给中国的法律带来了一种全新的景象，面对中国法律改革取得的种种成果，无论是中国国内还是国外都应秉持一种积极态度，用纯学术的角度评价各项措施，用实际成果来看待中国取得的进步，包括逮捕率的下降，重罪率的下降以及法官整体水平的上升。倘若带有各种偏见，将错过中国法律改革带来的诸多好处，而这些东西同样是法治的核心组成部分。
