사립학교법상 대학평의원회 제도의 문제점과 개선방향

국문 초록

1990년 사립학교법 개정에 따라 임의적 심의기구로 도입된 대학평의원회는 2005년과 2007년 사립학교법 개정으로 필수적 심의기구이면서 일부 사항에 대하여 자문 기능도 수행하게 되었다. 2007년 이후 대학평의원회에 관한 규정은 개정되지 않았지만, 다수의 개정안이 제안되는 등 여전히 뜨거운 이슈이다. 이 연구의 내용·결과는 다음과 같다. 첫째, 대학평의원회의 권한이 회의체로서는 이례적으로 자문·심의로 이원화되었는데 그 배경과 타당성을 검토할 필요에 따라, 우선 일반론으로서 자문과 심의의 구분에 관한 분류 및 유형화를 모색하였다. 이를 토대로 사립학교법상 대학평의원회 관련 규정을 연혁적으로 분석하여 그 기능이 자문과 심의로 조정된 이유를 확인하였다. 그 결과 대학평의원회의 심의사항 중 일부가 자문사항으로 조정된 것은 이사회와의 권한 조정의 결과임을 알 수 있었다. 둘째, 운영상의 문제점으로는 기존 기구들과의 권한 중복, 평의원회 의원의 전문성 부재, 고등교육법과 사립학교법의 규율 중복 등 문제점을 확인하였으며, 이에 대한 개선방안을 검토하였다. 특히 고등교육법과 사립학교법의 규율 중복과 관련해서는 대학평의원회는 고등교육법으로 국·공립·사립의 모든 대학을 규율할 것을 제안하였다.

영문 초록

The university council, which was introduced as an optional deliberation agency in accordance with the amendment of the Private School Act in 1990, became an essential deliberation agency due to the amendment of the Private School Act in 2005 and 2007, and also acted as an advisory function on some matters. Regulations on university councils have not been amended since 2007, but it is still a hot issue, with a number of amendments being proposed. The contents and results of this study are as follows. First, the authority of the university council was divided into advice and deliberation, which was unusual for a conference agency. In accordance with the need to review the background and validity, this study first sought to classify and type the distinction between advice and deliberation as a general theory. Based on this, the regulations related to the university council in the Private School act were analyzed historically and the reasons why the functions were adjusted by advice and deliberation were confirmed. As a result, it was found that some of the deliberations of the university council were adjusted to advice as a result of the adjustment of authority with the board of directors. Second, operational problems such as overlapping authority with existing organizations, lack of expertise of council members, and overlapping regulations between the Higher Education Act and the Private School Act were identified, and improvement measures for these were reviewed. In particular, regarding the overlap of regulations between the Higher Education Act and the Private School Act, this study proposed all university councils in national, public, and private universities to be regulated by the Higher Education Act.
