국문 초록

이 연구는 초·중·고등학교 교원의 교권 판례를 비교 분석하여 각 학교급에서 발생하는 교권 관련 법적 쟁점을 파악하고, 이를 바탕으로 교권 보호를 위한 시사점을 도출하는 데 목적이 있다. 학교급별 교원의 교권 판례를 비교 분석하기 위해 395건의 판례 중 51건을 선별하여 사건 개요와 주요 법적 쟁점을 살펴보았다. 연구 결과, 초등학교에서는 주로 학부모의 폭력 행위로 인한 교권 침해 사례가 많았으며, 중학교에서는 교원의 징계 처분의 적법성을 다투는 사건이 주를 이루었다. 고등학교에서는 학생의 교권 침해 행위로 인한 징계 및 퇴학 처분 사건이 주요 쟁점으로 나타났다. 각 학교급에서 교권 침해의 양상과 법적 대응이 다르게 나타나므로, 이를 반영한 학교급별 차별화된 교권 보호 정책이 필요하다는 결론을 도출하였다.

영문 초록

This study aims to compare and analyze legal precedents related to the rights of elementary, middle, and high school teachers in South Korea, identifying the legal issues arising at each educational level and deriving implications for the protection of teachers' rights. To compare the legal precedents across different school levels, 51 cases were selected from a total of 395 precedents, focusing on the case summaries and key legal issues. The study found that in elementary schools, cases of teacher rights violations due to parental violence were prevalent, while in middle schools, disputes primarily involved the legality of disciplinary actions against teachers. In high schools, cases centered on disciplinary actions and expulsions resulting from students' violations of teachers' rights. The findings highlight that the patterns of rights violations and legal responses vary by school level, suggesting the need for differentiated policies to protect teachers' rights tailored to each school level.
