국문 초록

학교폭력은 정부가 오랜기간동안 해결을 위해 노력해 왔음에도 불구하고 아직까지 학교폭력이 해결되지 않고 있다. 학교폭력이 해결이 쉽지 않은 것도 이유겠지만 해결의 방향이 문제일 수도 있다. 법적, 행정적 처리가 아닌 교육적 해결의 방법으로 방향을 설정할 필요가 있다. 학교폭력은 일반적으로 학생들에게 발생되고, 가해학생이 가해행위를 멈추었을 때 학교폭력은 해결될 수 있다. 이를 위한 제일 좋은 방법은 바로 교육이다. 이에 학교폭력 문제는 교육적으로 해결해야 한다. 현행법상 이러한 교육적 해결방법 중에 하나가 바로 학교장의 자체해결이다. 본 연구는 학교폭력 문제를 교육적 방법으로 해결하고자 하는 측면에서 학교장의 자체해결제도와 전담기구에 대한 현황과 입법과제를 살펴보고자 한다.

영문 초록

School violence has yet to be resolved, despite the government's long-standing efforts to resolve the problem of school violence. The reason why school violence is not easy to solve may be the reason, but the direction of solution may be the problem. It is necessary to set the direction as a method of educational solution rather than legal and administrative treatment. School violence generally occurs to students, and school violence can be resolved when the perpetrator stops committing the offense. The best way to do this is through education. Therefore, the problem of school violence must be solved educationally. Under the current law, one of these educational solutions is the Principal's Autonomous Resolution. In order to solve the problem of school violence in an educational way, this study aims to examine the current status and legislative tasks of the Autonomous Resolution System and dedicated organization.
