국문 초록

2024년 3월부터 학교폭력 발생시 학교의 사안처리 공정성과 객관성을 강화하고 교사의 학교폭력 사안조사 업무 경감을 통해, 학교가 보다 피해학생 지원, 관계 개선 등 학교의 교육적 기능에 집중할 수 있도록 학교폭력 전담조사관 제도가 도입되어 운영되고 있다. 그러나 학교 차원에서 교사동석 의무화, 목격 관련 학생 진술 확보상 문제점, 학교폭력 전담조사관이 사안조사 처리 기간상 문제, 그리고 사안조사 이외의 모든 행정절차는 학교에 있다는 점 등이 문제로 제기되었다. 또한, 학교폭력 전담조사관의 처우와 역량에 대한 문제 및 권한 등도 문제로 제기되었다. 이에 연구에서는 도출된 문제점 등에 대한 개선방안을 모색하였고, 국회에서 발의된 관련 개정법안이 지니고 있는 한계 등을 제시하였다.

영문 초록

From March 2024, a school violence investigator system has been introduced and operated so that schools can focus more on the school's educational functions, such as supporting victims and improving relationships, by strengthening the fairness and objectivity of school violence in the event of school violence, and reducing teachers' investigation of school violence cases. However, problems were raised at the school level, including mandatory teacher attendance, problems in securing student statements related to eyewitnesses, problems with the duration of the case investigation, and the fact that the school violence investigator is in charge of all administrative procedures other than case investigations. Problems and authority over the treatment and competence of school violence investigators were also raised. Accordingly, this study present improvement measures for the problems derived, etc., and suggested the limitations of the related revised bill proposed by the National Assembly.
