국문 초록

그 동안 우리나라는 주로 R&D 지출에 대한 세금감면을 통해 혁신기술 투자를 장려하여 왔다. 그러나 전 세계적으로 혁신기술을 가진 다국적기업 유치경쟁이 치열해지면서 R&D 성과물의 사업화소득에 우대세율을 적용하는 특허박스제도에 관한 관심이 증대하고 있다. 특허박스제도 도입과 관련하여 가장 큰 이슈는 특허박스소득을 어떻게 산정하고, 세무당국이 이를 어떻게 검증할 것인가 하는 문제이다. 본 연구는 영국과 네덜란드 세무당국이 이 문제를 어떻게 해결하였는지 양국의 특허박스제도를 조사했다. 또한 기업실무자를 대상으로 심층인터뷰 및 설문조사를 수행하여 국내실정에 적합한 특허박스 도입방안을 설계했다. 구체적으로 본 연구는 법인이 신성장·원천기술 및 국가전략기술에 대한 R&D활동의 결과로 획득한 특허를 활용하여 얻은 사업소득에 대해 대기업은 12%, 중소기업은 5%의 우대세율을 적용하는 특허박스 제도의 도입을 제안했다. 본 연구는 외국제도에 대한 조사에 그치지 않고, 기업실무자에 대한 설문조사를 바탕으로 국내실정에 적합한 특허박스도입방안을 구체적으로 제시함으로써 향후 특허박스 도입과 관련된 정책적 논의에 중요한 실무적 공헌점을 가질 수 있을 것으로 기대된다.

영문 초록

Korea has been encouraging investment in innovative technologies mainly through tax credits for R&D expenditures. However, as competition to attract multinational companies with innovative technologies intensifies worldwide, interest in patent boxes is increasing. In order to design a patent box that fits domestic circumstances, we investigate overseas cases and conduct a survey. The UK calculates the patent box deduction using a structured formula, so the burden of verification by the tax authorities is low. In addition, the UK provides taxpayers with a detailed manual. Meanwhile, the Netherlands eliminates the uncertainty of the patent box by using the ruling. Dutch companies can apply for R&D tax credit and patent box only if they receive an R&D certificate from RVO. We judged that the British method is more desirable among the two countries. Therefore, we design a Korean patent box based on the British method. We propose the Korean patent box that applies a preferential tax rate of 12% for large corporations and 5% for small and medium－sized enterprises to business income derived from patents acquired as a result of R&D activities for new growth and national strategic technologies. The introduction of the patent box is expected to contribute to strengthening our country's national competitiveness as a base for innovative companies by strengthening tax support for commercialization of patents.
