공공갈등 해결에 있어 ‘조정연계중재’의 활용 가능성에 대한 탐색적 연구 - 여주시 하동제일시장 갈등 사례를 중심으로

국문 초록

본 연구는 한국사회 공공갈등 해결에 있어 ‘조정연계중재(Med-Arb)’의 활용 가능성을 탐색하는 것을목적으로 한다. 조정연계중재의 활용은 조정과 중재가 순기능적으로 연계되는 것이 핵심인바, 본 연구는여주시 하동제일시장 갈등 사례를 대상으로 조정과 중재의 적합한 연계 조건에 대해 분석하였다. 분석결과, 조정을 통해 당사자 간 자율적 합의에 이르지 못하더라도 조정 과정에서 중재를 활용하여 갈등을최종적으로 해결할 수 있는 조건을 도출한다면 조정연계중재가 실효적으로 작동될 수 있음을 확인하였다. 구체적으로 조정 과정에서 갈등해결의 시급성이 공유되고, 갈등 쟁점이 단순화되거나, 갈등당사자간 관계가 문제해결에 필요한 정도로 개선되었지만 당사자 내부의 문제로 인해 자율적 합의를 위한리더십이 구축되어 있지 못할 경우 조정연계중재는 매우 유용한 갈등해결수단이 될 수 있음을 보여주였다. 아울러 공공갈등의 경우 조정연계중재를 제도적으로 강제하거나 사전에 합의되기 어려운 특성이있기 때문에 조정과 중재의 적합한 연계를 가능하게 하는 조정인의 높은 통찰력과 역량을 필요로 한다는점도 알 수 있었다.

영문 초록

The purpose of this study is to examine the possibility of Med-Arb in resolving public conflicts in Korea. The key to the use of Med-Arb is that mediation and arbitration are suitably combined. For this, this study analyzed the suitable combination of mediation and arbitration based on the case of conflict at Hadong First Market in Yeoju-si. The results of the analysis confirmed that Med-Arb can work effectively if the conditions for finally resolving the conflict by using arbitration are derived from mediation, even if the parties cannot reach an autonomous agreement through mediation. Specifically, it has been shown that Med-Arb can be a very useful means of resolving conflicts if the urgency of conflict resolution was shared, conflict issues were simplified in the mediation, or the relationship between conflicting parties improved to the extent necessary to solve the problem, but leadership for autonomous agreement was not established due to problems within the parties. In addition, it was found that Med-Arb requires high insight and skills of mediator that enable appropriate linkage between mediation and arbitration.
