국문 초록

본 연구는 북한과 중국의 토지관리제도의 도입 및 운영과정에 대한 현황과 토지관리제도 중 소유권에 관한 특징을 비교·분석하고 통일을 대비하는 우리나라의 관점에서 시사점을 제시하는 것을 목적으로 한다. 이를 위하여 사회주의 국가의 토지관리제도, 북한과 중국의 토지 소유 및 이용권에 대하여 문헌 고찰하고 북한과 중국의 토지관리법제 및 운영 현황을 비교·분석하였다. 시사점으로는 북한과 중국은 토지관리제도 및 법률적 관점에서는 거의 비슷한 형식을 갖추고 있다. 중국은 정치·경제체제의 변화에 따라 토지소유권 개념에 다소 변화를 해오고 있는 반면, 북한은 사회주의 경제체제를 그대로 유지하고 있다. 따라서 북한도 중국과 같이 토지소유권과 관련하여 개량 자본주의적 경제체제를 적용하여야 할 것이다. 이를 통해 한정된 재산권의 사용·수익·처분에 대한 경제 개념에 대한 변화를 통해 효율적인 토지관리와 최고의 효용을 모색하여야 할 것이다.

영문 초록

This study aims to present implications from the perspective of Korea preparing for unification by comparing and analyzing the current status of the introduction and operation of land management systems in North Korea and China and the characteristics of ownership among land management systems. To this end, corresponding references were reviewed on land management systems in socialist countries, land ownership and use rights in North Korea and China, and compared and analyzed the land management laws and operations in North Korea and China. As a implication, North Korea and China have almost similar forms from a land management system and legal point of view. China has changed the concept of land ownership keep up with the trend of political and economic system, while North Korea maintains its socialist economic system. Therefore, North Korea should experience a capitalist economic system related to land ownership like China to acquire economic concepts for the use, profit, and disposal of limited property rights, and seek efficient land management and the best utility.
