시민교육 관점에서 본 교권

국문 초록

목적 본 글은 교권 침해 사건과 관련하여 교사는 교육주체가 맞는가에 대한 문제의식에서 출발한다. 그리고 이에 대한 논의를 위해 교육의 전문성에 근거한 교권의 법적 성격을 논의하였다. 방법 교권 보호를 위한 교육 관련 법률의 입법 현황을 검토하고, 그 한계를 분석하였다. 그리고 그 한계에 대해 ‘교권은 보호의 객체인가?’에 대한 문제를 제기하였으며, 교권을 교육의 전문성 측면에서 검토하였다. 결과 논의 결과 최근의 교권 보호를 위한 입법은 교사의 법률상의 지위 혹은 권한을 강화하기 위한 입법 조치가 아니라 학생 및 학부모의 책임과 의무를 강화하는 소극적 입법 혹은 통제(의부 부과) 중심의 입법을 중심으로 교권 보호 목적을 달성하려 한다는 비판을 하였다. 교육의 전문성에 근거한 교사의 권리와 권한을 강화하기 위한 방안이 필요하다. 결론 이에 따라 본 글은 시민교육의 관점에서 교사를 보호의 객체에서 교육의 전문성의 주체로 그 권한을 강화하고 존중해야 함을 강조하였다. 더 나아가 학생 인권과 교권이 충돌하는 가치가 아니라면 결국 교권 회복을 위한 최종적인 해결책은 민주적이고 인권친화적인 학교문화의 정착을 통해 학생 인권과 교권을 모두 보호해야 함을 강조하였다.

영문 초록

Objectives The purpose of this study is to discuss the legal nature of teaching rights based on educational ex-pertise and to discuss ways to restore teaching rights from a civic education perspective. Methods For this purpose, reviewed the legislative status of education-related laws to protect teaching rights and analyzed their limitations. Regarding its limitations, the question was raised, ‘Is teaching authority an object of protection?’ In addition, teaching authority was reviewed from the perspective of educational expertise. Results As a result, the recent legislation to protect teaching rights was seen as a passive legislation that strengthens the responsibilities and obligations of students and parents, rather than a legislative measure to strengthen the legal status or authority of teachers. Conclusions Accordingly, from the perspective of civic education, this article strengthens the authority and au-thority of teachers from objects of protection to subjects of educational expertise, and emphasizes the establish-ment of a democratic and human rights-friendly school culture.
