신기후체제 하에서 신재생에너지정책과 WTO협정의 주요쟁점 및 개선방안

국문 초록

파리협정이 발효되면서 신기후체제가 도래하게 되었고, 지구온난화를 방지하기 위하여 온실가스 배출이 적은 신재생에너지에 대한 각국의 정책이 시행되고 있다. 에너지정책의 시행과 보호무역주의적인 각국의 조치들로 인해 WTO 분쟁이 증가하였다. 본 연구는 신재생에너지와 관련된 WTO 분쟁사례를 검토하고, 보조금 및 상계조치협정, 반덤핑협정 및 GATT를 중심으로 주요 쟁점을 도출하였다. WTO협정이 신재생에너지산업의 발전과 조화를 이루어나갈 수 있는 방향에 초점을 두고 현행 WTO규범의 개선방안을 제시하였다. 첫째, SCM협정에서는 주요 쟁점인 보조금의 요건과 수입대체보조금 조항에 대한 개선을 위해 허용보조금의 재도입을 제시한다. 둘째, 반덤핑협정에서 특정한 시장상황이라는 용어의 해석기준을 마련해야 한다. 셋째, WTO의 목적에 반하지 않는 범위에서 GATT 제20조 일반적 예외의 해석을 완화하여 신재생에너지정책을 사안별로 평가하여 GATT 제20조 일반적 예외를 원용할 수 있도록 한다.

영문 초록

Purpose : The purpose of this study is to suggest ways for efficient linkage each country's renewable energy policies under the New climate regime and WTO rules governing international trade. Research design, data and methodology : This paper This study analyzes case studies of WTO disputes related to renewable energy, as well as literature research that analyzes domestic and international literature related to energy policy and WTO agreements. Results : According to the case study, some issues were found from ASCM and Anti-dumping agreements and GATT. First, it is about meeting subsidy requirements in ASCM. Second, there are disputes applying the concept of Particular Market Situation in the Anti-Dumping Agreement. Thirdly, it is a question of the applicability of Article 20 of GATT. Conclusions : This paper presented improvements for each WTO agreement related to issues. It includes the criteria of Article 3.1 and the reintroduction of Article 8 in ASCM, the interpretation of Article 20 of GATT on environmental measures.
