해상운송과 내수운송의 적용범위에 관한 고찰

국문 초록

우리나라 법령상 내수운송은 육상운송의 일부로 취급되어 상법의 육상운송규정이 적용된다. 이는 내수운송 자체가 해상운송과는 달리 그 규모가 작고 빈번하게 이루어지기 때문이다. 그러나 내수운송을 실행하는 육상운송인과 해상운송을 실행하는 해상운송인의 책임체계는 법령상 큰 차이가 있어, 육상운송인은 상법상 책임제한이나 면책사유 등의 항변을 사용할 수 없다. 따라서 육상운송 내지 해상운송의 범위 확정은 운송사업의 위험분배와 관련하여 대단히 중요한 의미를 가지는데, 문제는 육상운송에 포함되는 내수운송을 함에 있어, 그 내수의 범위가 모호해지거나 해상운송과 중첩되어지는 경우도 있다는 점이다. 본 논문에서는 이 문제와 관련하여 해상운송과 내수운송에 대한 법령상의 범위를 재검토하여 구체적인 쟁점과 문제들을 점검해 보았다. 구체적으로는 우리나라 상법상 해상운송구간에 적용되는 법규 현황 및 쟁점을 개관해 보았으며, 미국, 영국, 독일, 프랑스, 일본 등 주요국의 해상운송 규율에 적용되는 입법례를 살펴보았다. 이후, 우리나라 상법상 해상운송의 범위에 관한 실무적 시사점 제시와 함께 개별적인 입법적 개선방안을 모색해 보았다.

영문 초록

Purpose : This study analyzed the issues in the scope of carriage by sea and carriage by inland waterways under the Korean Commercial Code. Research design, data and methodology : Article 125 of the Korean Commercial Code says that the term carrier means a person who engages in the business of carrying goods or passengers by land or on lakes and rivers, and in ports and bays. This paper studied Article 125 and the Articles of the Code concerning the carriage of goods by sea. Results : Comparative analysis of some issues in the scope and application of carriage by sea or carriage by inland waterways suggests that maritime carriage provisions of the Korean Commercial Code should be applicable to inland waters. Conclusions : This paper reviewed and analyzed issues in the scope of maritime carriage and inland waterways transport under the Korean Commercial Code by examining the theories, regulations, and practical viewpoints. This paper, also, presented related practical and legal implications and further reforms in the Korean Commercial Code.
