국문 초록
LGBTQ+(레즈비언, 게이, 양성애자, 트랜스젠더, 퀴어 등 성소수자)들의 높은 폭력 피해율은 우리 사회가 직면하고 있는 심각한 문제이다. 본 연구는 LGBTQ+들의 폭력 피해와 관련한 기존의 연구들과 미국 형사사법시스템의 LGBTQ+에 대한 차별금지 법률, 규정 및 정책을 검토하여 시사점을 도출하였다. LGBTQ+들의 폭력 피해에 효과적으로 대응하고 LGBTQ+ 피해자들에게 적절한 법률 및 의료 서비스를 제공하기 위해서는 형사사법기관들의 성소수자 대응과 관련한 구체적이고 명확한 차별금지 규정 및 인권보호 정책의 수립이 필수적이다. 나아가, 형사사법기관 종사자들의 성소수자에 대한 차별적 인식과 태도를 개선하기 위한 전문적인 교육과 훈련이 시행되어야 한다.
영문 초록
The high rate of violent victimization of LGBTQ+ individuals is a serious problem in South Korea. To provide suggestions on how to address the problem, the current study reviews the existing literature on violent victimization of gender and sexual minority individuals and the relevant U.S. laws, prohibitions, and policies. This study suggests that the South Korean criminal justice system should establish explicit anti-discrimination prohibitions and policies regarding criminal justice professional interactions with LGBTQ+ populations. Furthermore, it is essential to implement specialized education and training devoted to eliminating criminal justice professionals’ prejudicial beliefs and oppressive attitudes against LGBTQ+ populations to effectively respond to violence against LGBTQ+ individuals and provide appropriate legal and medical services to LGBTQ+ victims.
