영문 초록

Ⅰ. Introduction In 2020, a total of 163 criminal cases were sentenced by the Korean Supreme Court. These cases refer to the data registered on the court website.1) Among them, 10 criminal cases of which are decided by the Grand Panel, were included. It is Interestin that 4 of 10 cases by the Grand Panel are cases of breach of trust. In this article, 5 cases by the Grand Panel and other several cases that is remanded after reversal are reviewed. The review of cases is as follows : 1. The Fact of Case, 2. The Reason for Judgment, 3. The Note. Ⅱ. The Cases of the Grand Panel of the Korean Supreme Court In this chapter, 5 cases of the Grand Panel are reviewed. The subjects of the cases are ‘discretionary disposition of movable property secured for transfer and breach of trust’, ‘Real estate double mortgage and breach of trust’, ‘the meaning of fraudulent in sexual intercourse by fraudulent’, ‘Maintenance of the theory of propagation by defamation’, ‘The Concept of falsification by Falsification or Alteration of Private Electromagnetic Records’. Ⅲ. The Cases related to the General Part of Criminal Law In this chapter, 5 cases art reviewed. The subject is related with repeated crime, labor dispute and Justifiable Act, compliance with the social service order, the range of relative by rape. Ⅳ. The Cases related to the Special Part of Criminal Law In this chapter, 5 cases are reviewed. The subject is related with organization of criminal groups, conscientious objection to military service, intrusion upon habitation, fraud and if more than one person is involved in the creation of the work, who is the author.
