국문 초록

현대 사회는 과학기술이 발달하여 과학기술이 일상적 삶에 내재화되는 단계를 거쳐, 과학기술에 기대어 사회적 문제에 대처하고 국가적 삶을 조직하게 될 뿐 아니라 나아가 과학기술자와 시민의 구별이 어려운 과학기술사회에 진입하고 있다. 이렇게 과학기술사회가 현실이고 미래라면, 헌법전에 이 사회상을 투영하여 국가적 삶의 틀을 명시적으로 부여하는 것이 필요할 것이다. 이를 위해 과학기술에 관한 인권적 접근의 역사를 살펴보는 것이 필요하다. 과학기술에 대한 인권은 이미 1948년 세계인권선언에 규정된 바 있고, UN인권규약과 2차례의 세계인권회의 등을 통해 지속적으로 제시되고 있는 보편적 인권이다. 과학기술과 관련된 인권규범은 대체로 과학기술의 중립성에 기초한 1단계, 과학기술의 위험성을 강조한 2단계, 과학기술을 시민의 역량 아래 두는 새로운 접근을 제안하는 3단계로 나눌 수 있다. 다만, 3단계의 경우 아직 어떻게 정립해야 하는지에 대해 명확하게 제시되지는 않은 것으로 생각된다. 결론적으로 이런 맥락을 고려하여 헌법에도 과학기술에 대한 기본권을 비롯한 제반 규정이 마련되는 것이 바람직할 것으로 생각된다.

영문 초록

In contemporary society, science and technology develops, and science and technology are internalized in everyday life, and in addition to tackling social problems and organizing national life. If the science and technology society is real and future, it will be necessary to explicitly give the framework of the Constitution. To do this, it is necessary to look at the history of human rights approaches to science and technology. Human rights to science and technology were already defined in the Universal Declaration of Human Rights in 1948, and are universal human rights that have been continuously presented. Human rights to science and technology can be roughly divided into the first stage based on the neutrality of science and technology, the second stage highlighting the dangers of science and technology, and the third stage suggesting a new approach to put science and technology under the capacity of citizens. In conclusion, considering this context, it is desirable that the constitution also has provisions including human rights to science and technology.
