국문 초록

이 연구는 형사사법절차 단계별 투입 및 산출되는 범죄자 통계를 바탕으로 범죄로 기소, 공판, 실형을 받을 확률을 분석하였다. 2011년부터 2018년까지 경찰, 검찰, 법원, 교정본부 등 형사사법기관에서 매년 발간하는 공식통계를 사용하여 확률을 분석하였다. 분석한 결과에 의하면 범죄검거건수 및 범죄자 처분 인원 대비 기소 확률 39.8%, 공판 확률 8.6%. 실형 확률 2.8%, 수형 확률 1.8%로 나타났다. 미검거건수를 고려하여 전체 범죄발생건수 및 추정 범죄자 인원 대비 범죄 검거 확률 80.7%, 기소 확률 32.1%, 공판 확률 6.9%. 실형 확률 2.2%, 수형 확률 1.4%로 나타났다. 만약 범죄로 100명이 검거되어 형사사법절차에 투입되면, 검찰의 기소 40명과 공판 9명, 법원 형사공판에서 실형 3명, 교정시설 수형은 2명이 되는 것으로 나타났다. 미검거를 포함하여 경찰과 검찰 수사기관이 인지한 범죄자를 100명으로 추정하면, 대략 경찰과 검찰 검거는 81명, 검찰의 기소 32명과 공판 7명, 법원 형사공판에서 실형 2명, 교정시설 수형은 1명이 되는 것으로 나타났다.

영문 초록

The study analyzed the probability of being prosecuted, tried, and sentenced to prison for crimes based on the current statistics of criminals in stages of criminal justice procedures. From 2011 to 2018, it was analyzed using official statistics published annually by criminal justice agencies such as police, prosecution, court, and correctional headquarters. According to the analysis, the prosecution s probability of prosecution was 39.8% compared to the number of criminal cases and the number of offenders disposition, 8.6% of the probability of trial, 2.8% of the probability of imprisonment and 1.8% of imprisonment. Considering the total number of undetected crimes and the estimated number of criminals, the probability of arrest was 80.7% for criminals, 32.1% for prosecution, 6.9% for trial, 2.2% for prison sentences, and 1.4% for prisoners. If 100 people are arrested for crimes and put into criminal justice procedures, the prosecution will have 40 prosecutors, nine judges, three prison sentences in court criminal trials, and two prison sentences for correctional facilities. The estimated 100 criminals recognized by police and prosecution investigators, including the uncensored ones, were approximately 81, 32 prosecutors and seven prosecutors, two prison sentences in court criminal trials and one prison sentence for correctional facilities.
