영문 초록

The basic unit of litigation to which res judicata applies is a claim(civil proce-dure act §216 I). Identical claims, prior claims, contradictory opposites are the boundary of binding effect(former adjudication) of final judgements. The Res Judicata effect of final judgement on the cancellation of ownership registration preclude another action on ownership registration. The supreme court said that a claim on the cancellation of ownership registration and a claim on ownership reg-istration are substantially same claims. But these two claims are different. Substantially same means different. But the claims are contradictory opposite. The Res Judicata effect of final judgement on the cancellation of ownership regis-tration preclude another action on ownership registration, not because of the sub-stantially same claims but because of contradictory opposite.
