영문 초록

Medical dispute may be resolved by the court or ADR. This article focuses on malpractice litigation. The patient claims the responsibility of the medical staff, and should be proved. In order to reduce the burden on the patient, the medical records to be ensured. The court shall use the preparatory system for trial in malpractice litigation. This system is composed of ① proceedings for sorting out genuine issues after arranging assertions and evidence and ② proceedings for collecting evidence. This article emphasizes the importance of this system in malpractice litigation. Because it is difficult to collect the patient s medical record, and because the patient is difficult to prove the negligence of the doctor. Efficient preparation for trial in malpractice litigation is suitable for virtually redress the damage of the patient.
