국문 초록

국제상거래규칙으로 잘 알려진 Incoterms의 8차 개정판인 IncotermsⓇ2020이 공표되어 2020년 1월 1일부터 시행된다. 개정 IncotermsⓇ2020은 IncotermsⓇ2010과 비교할 때 개별규칙에서는 큰 변화가 없으나 몇 가지 특징적인 변화가 있었다. 첫째, 새로운 규칙인 DPU와 FCA 규칙에서는 본선적재 선하증권의 발행에 대한 옵션사항이 추가되는 등 실무적인 관행이 반영되었다. 둘째, 의무사항을 사용자가 쉽게 이해할 수 있도록 수평적 체제로 구성하였다. 셋째, 기존의 사용지침(Guidance Note)을 사용자를 위한 설명문(Explanatory Note for Users)으로 변경하여 더 명확하고 세부적으로 기술함으로써 사용자의 이해를 높이는 방향으로 개정되었다. 넷째, 총중량검증제(Verified Gross Mass)에 대한 의견수렴과 CIP와 CIF 규칙에 있어서 보험부보 범위를 차별화하여 당사자의 선택권을 넓혀주고자 하였다. 본 연구에서는 IncotermsⓇ2020의 주요 개정내용 중에서 인도 및 위험이전을 포함한 IncotermsⓇ2020의 선적매매 규칙에 중점을 두어 실무적 사용에 대한 유의사항에 관한 의견을 제시하고자 한다.

영문 초록

Purpose : This study would like to comment on the major revisions of the IncotermsⓇ2020 and the precautions for the practical use of the IncotermsⓇ 2020 s shipping sale rules. Research design, data, methodology : This paper is composed of five chapters based on literature studies. Chapter Ⅰ deals with the introduction of this paper and Chapter Ⅱ explains the revised main contents of IncotermsⓇ2020 rules. Chapter Ⅲ deals with attention point for its practical use of Shipping Sale Rules. Chapter Ⅳ concludes this paper. Results : The revised IncotermsⓇ2020 does not make significant revisions to the individual rules as compared to IncotermsⓇ2010, but in the practical part of the new rules DPU and FCA rules added options for the issuance of bills of lading, etc. Conclusions : In the case of using the trade in IncotermsⓇ2020 rules for international commerce, delivery and an understanding of the differences between the F rule and the Crule, represented by symbolic guidance, is needed. In addition, the place of delivery and the destination should be clearly stated when preparing the contract.
