국문 초록

의학기술의 발달로 사람의 수명이 늘어남에 따라 2017년 고령사회에 진입한 우리나라를 비롯한 인구 고령화 국가들은 ‘간병 살인’이 사회적 문제가 되고 있다. 따라서 간병살인으로 인한 가정파괴의 심각성 감소와 예방을 위한 대응방안을 모색하는데 연구 목적을 두었다. 간병살인 범죄에 대한 이론적 논의와 실태분석을 통해 간병살인 범죄의 발생원인과 특징·문제점을 확인하였으며, 이를 바탕으로 국가차원의 나아갈 정책방향과 대응방안에 대한 논의를 진행하였다. 식별된 문제해결을 위해 다음과 같은 방안을 제시하였다. 첫째, 간병가정에 대한 정확한 실태파악 및 현황유지가 이루어져야 한다. 둘째, 간병인 고충해소를 위한 다 양한 복지지원ㆍ시설이 확충되어야 한다. 셋째, 2025년 우리나라가 초고령사회로 진입하여 간병살인 범죄가 증가될 것으로 예상됨에 따라 적극적이고 체계적인 정책추진을 위한 국가차원의 전담기구가 신설ㆍ운영되어야 한다. 마지막으로 간병살인 처벌에 관한 감경적 구성요건 규정이 필요하다.

영문 초록

As medical technology increases people s lifespan, Korea and other aging countries, which entered the aged society in 2017, have become a social problem. Therefore, the purpose of the study was to find countermeasures to reduce the severity of home destruction caused by nursing murder and prevent it. Through theoretical discussion and analysis of the status of nursing murder crimes, the causes, characteristics, and problems of nursing murder were identified, and the policy direction and countermeasures for the national level were discussed based on this. For the solution of identified problems, the following measures are proposed. First, accurate status destruction and maintenance of the st atus of nursing homes should be done. Second, various welfare support and facilities for the relief of caregivers should be expanded. Third, as the nation is expected to enter a super-aged society in 2025, an agency dedicated to actively and systematically promoting policies should be established and operated. Finally, there is an emotional component regulation on the punishment of nursing murder.
