국문 초록

이 연구는 대한민국과 대만 및 일본의 국가의 지방교육행정기관에 대한 감독 관련 법률을 비교 분석한 것이다. 세 개 국가의 지방교육자치 구조를 간략히 소개하고, 지방교육사무의 성격, 지방교육행정기관에 대한 국가 관여의 조건과 방식, 국가의 자의적 관여 가능성에 대한 예방 장치의 존부, 국가 관여에 대한 지방교육행정기관의 이의 제기 및 처리 방식, 행정 조정을 위한 기구의 성격과 조정 절차 및 효력을 준거로 세 개 국가의 관련 법률을 비교 분석하였다. 연구 결과, 국가 감독의 법률주의와 감독의 방식과 절차 상세화, 국가의 행정적 관여 이전의 사법적 판단 절차 활용, 행정협의조정위원회 운영의 개선 등을 현행 법률의 개선 과제로 제시하였다.

영문 초록

The laws regarding the state control of local education authorities of Japan, Korea, and Taiwan are analyzed in this study. After some brief introductions of the structure of the local education autonomy of three countries are given, the three states` law are analyzed according to the following five criteria: the character of local education works; the conditions and ways of state control onto local education authorities; the yes or no of some devices that protect the arbitrary control of the state; the ways that local eduction authorities raise an objection to the state control and the process that deals with the objection; the devices for arbitration and compromise between two administrative agencies. Based upon the comparative analysis, the three tasks for improving Korean law are suggested. The state intervention on local education authorities must be under the rule of law. The process and ways for controlling local education authorities should be more detailed. Finally, the present committee for arbitration and compromise between MOE and LEAs should be reformed in terms of its operaton and efficacy.
