국문 초록

UNCITRAL에서 ODR과 관련된 규칙의 제정이 본격적으로 논의된 배경에는 우선, 전자상거래의 급증에 빠른 분쟁의 증가로 이에 대한 효율적인 대응이 필요하였다는 것이다. 국제기구 차원 에서 OECD, ICC 등에서도 ODR에 대한 활발한 논의가 있었으나 조직적 한계로 ODR이 가지는 법적 문제를 해결할 수 있는 방안을 찾기 어려웠기 때문에, UNCITRAL에서 본격적으로 ODR를 논의하게 되었다. EU에서는 ODR규칙을 제정하여 ODR플랫폼을 운영하는 모범사례가 있으나 단일시장에 국한되고 있다는 점에서 글로벌 차원에서의 문제해결 수단으로서는 한계가 있다. 따라서 지역적인 한계를 벗어난 글로벌 차원에서의 접근이 필요하였다. 2010년부터 2016년까지 UNCITRAL에서 ODR과 관련된 논의가 이루어졌고, 2017년 12월 13일에는 ODR기술지침이 채택되었다. 따라서, 기존의 연구들은 2017년 이후의 전개를 충분히 다루지 못했는데, 특히 UNCITRAL 작업반 Ⅲ에서 논의되었던 초안을 대상으로 한 연구들이 많아서 최종안을 대상으로 한 연구가 부족한 상황이다. 본 연구는 UNCITRAL ODR기술지침의 주요 내용을 살펴보고 그 활용성을 검토하고자 한다. 이를 통해 UNCITRAL ODR기술지침이 폭넓게 활용되고 실효성을 높임으로써 ODR의 원활화에 기여하는 것을 그 연구목적으로 한다.

영문 초록

Purpose : This study attempts to review the key features of UNCITRAL Technical Notes on ODR, and identify the policy challenges including utilizability in global trading practice. Thus, the purpose of this study is to contribute to streamling ODR by introducing these technical notes in ODR platforms on a global basis. Research design, data, methodology : This paper is composed of five chapters based on literature studies. Following the introduction (Chapter I), Chapter II explains the background and structure of the ODR Technical Notes. Detailed clauses and their practical implication are articulated in Chapter III. Chapter IV identifies the utilizability of the ODR Technical Notes. Chapter V concludes this paper. Results : ODR Technical Notes are expected to provide technical and operational requirements of an ODR platform with extendability. With proper security support, it is also expected to provide a basis of institutional accreditation of ODR platforms for secure and fast dispute resolution. Conclusions : ODR Technical Notes have a potential to be an enabler for effective ODR platforms accomodating various methods including facilitated resolution in both global and domestics dispute resolution processes.
