국문 초록

최근 인공지능, 사물인터넷, 블록체인의 등장은 정보를 수집하여 어떻게 가공하고 활용하느냐가 경쟁력의 주요한 원천으로 되고 있다. 또한 블록체인기술은 다양한 산업 분야에 적용되고 있으며 국제상거래 분야에도 적용되면서 많은 영향을 미칠 것으로 예상됨에 따라 무역거래에서 블록체인을 활용하기 위한 비즈니스 생태계를 마련할 필요가 있다. 그러나 무역거래에서 블록체인기반 스마트계약이 적용되기 위해서는 해결해야 할 많은 과제들이 존재하는데, 그 중에서도 가상화폐 규제문제, 스마트계약의 법적 효력문제, 거래생태계 마련 등 다양한 해결과제들이 있다. 특히 가상화폐에 대한 규제와 스마트계약의 법적 효력문제를 해결하는 것은 국제상거래에 스마트계약의 적용을 위해 시급한 제도적 선결과제이다. 따라서 국제상거래에서 블록체인기반 스마트계약의 도입에 대한 필요성과 더불어 국제상거래 에서 스마트계약의 적용사례를 소개하고 블록체인기반 스마트계약의 적용을 위한 해결과제를 제안하고자 한다.

영문 초록

Purpose : This study examines the major contents of the block chain and smart contract and discusses the changes in international commerce transaction market due to the introduction of block chain based technology and the necessity of introducing block chain based smart contract in international commerce transaction. Research design, data, methodology : This paper is composed of five chapters based on literature studies. Chapter Ⅰ deals with the introduction of this paper and Chapter Ⅱ explains the definition and application of Smart contract with block chain. Chapter Ⅲ deals with Case Study of smart contract in international commerce transaction. Chapter Ⅳ deals with solution task for smart contracts in international commerce transaction. Chapter V concludes this paper. Results : The block chain-based smart contract platform with strong security and de-neutralization characteristics can improve transaction stability by providing efficiency and transparency in international commerce transaction. Conclusions : In order for smart contracts to be applied to international commercial transactions, it is necessary to actively cooperate and make efforts with related parties who have interests in the fields related to existing international commercial transactions. In addition, the government needs to complement the institutional part for the realization of smart contracts.
