국문 초록

범죄자의 테러리스트로의 급진화 현상은 국외의 학자들 간에 매우 중요하게 다루어지고 있는 논쟁점이다. 911 테러사건 이후 다수의 국가에서 교도소가 테러리스트를 배양할 수 있는 위험한 시설이라는 증거들이 제시되었다. 교도소의 열악한 환경과 상황과 범죄자들의 내재적 범죄성의 결합은 그 위험성을 가중시키고 있다. 반면, 일부 학자들은 교도소 내의 테러리스트의 급진화는 매우 극소수의 사례이며 교도소 테러리스트 모집은 심각하지 않은 문제라는 주장도 존재한다. 그러나 이와 같은 논쟁에 대한 분석연구는 아직까지 미진한 상태이다. 따라서 이 연구는 국외의 교도소 내의 테러리스트 급진화와 관련된 연구와 실제 사례 등에 대한 이해를 통해서 국내의 교도소 내 테러리스트 급진화와 관련된 정책적 접근에 대한 논의를 제공하고자 하였다. 문헌분석을 통한 교도소 내 수용자 급진화와 관련된 개념, 사례, 이론적 설명 그리고 국내의 형사사법과 관련된 정책적 함의 등이 논의되었 다.

영문 초록

Terrorist radicalization in prison settings became an emerging issues among scholars in the fields of terrorism and criminal justice. There are pros and cons regarding the argument that prisons became breeding grounds for terrorist radicalization. That is, various risk factors surrounding prison conditions, such as criminality of inmates, hostile subculture in prison, and the agony of deprivations for inmates. in addition, religious conversion in prisons may play an important role in radicalizing prisoners through religious identity. Yet, there are still lack of studies examining the current issues, especially in domestic research settings. Therefore, this study attempts to provide an overview of prison radicalization and several case studies relevant to this subject, including theoretical models explaining process of prison radicalization. Especially, this study investigate the JIS case in the US as an example case to provide political implication regarding prison radicalization. In discussion, this study discussed policy implications and future research suggestions on this topic.
