해상보험에서 전쟁위험의 담보: 박탈의 위험을 중심으로

국문 초록

해상보험에서 면책되거나 또는 특약에 의하여 담보되는 전쟁위험은 크게 3가지 그룹으로 나눌 수 있는 것으로 보인다. 전쟁행위 또는 무력이 수반되는 전쟁 그 자체의 위험, 소유권･ 점유권･사용권을 박탈하거나 제한하는 박탈의 위험 그리고 전쟁무기의 위험이 그것이다. 이논문에서는 이들 중 박탈의 위험을 중심으로 영국해상보험법 및 약관상의 취급을 검토한다. 즉 박탈의 위험이 적하 또는 선박보험 등에서 어떻게 면책되며, 전쟁보험특약에 의하여 어떻게 담보되는지를 살펴본다. 박탈의 위험은 다시 소유권과 점유권 등의 강제적 탈취 또는 박탈과 관련된 포획･나포, 대체로 국가기관의 공적 사용을 위한 재산권 박탈과 관련된 몰수･수용 및 정부 등에 의한 정치적 또는 행정적 행위로서의 강류･억지･억류로 나누어 살펴볼 필요가 있다. 전쟁보험특약에 의하여 박탈의 위험이 담보되더라도 양자의 담보범위에 있어서 일정한 차이가 존재한다는 점에 유의해야 한다.

영문 초록

Purpose : This study aims to examine the insurance against the perils of deprivation as war risks, including capture, seizure, arrest, restraint, detainment, confiscation and expropriation. Research design, data, methodology : This paper deals with English law and practice of marine insurance regarding the insurer’s liability to pay for the loss due to the perils of deprivation as war risks. Results : According to this research, marine insurance includes both marine perils and war risk perils. War perils including the perils of deprivation are excluded from the ordinary marine cover. However, the excluded war risks can be insured under a separate policy, which provides cover for those specifically excluded war risks. Conclusions : The war risks insurance covers cargo, hull and machinery, loss of hire, P&I and occupational injury. The perils of deprivation are covered by an insurance against war risks.
