국문 초록

보상금 제도는 권리자와 이용자사이의 이익을 조정하는 유용한 수단으로, 독일을 비롯한 세계 각국의 저작권법에서 널리 활용되고 있다. 우리나라도 1986년 방송보상금제도를 도입한 이래 교과용도서와 수업(지원)목적 등 교육목적보상금과 도서관보 상금, 상업용 음반 이용에 대한 공연⋅디지털음성송신 보상금제도 등을 운영 중에있다. 보상금 제도는 장점에도 불구하고 아직 풀어가야 할 과제들이 적지 않은 것이 사실인데, 그 중에서도 가장 큰 현안은 미분배보상금의 처리이다. 현재 3개 수령단체에서 징수하였으나 분배하지 못한 ‘미분배 보상금’은 424억원에 이른다. 이에 대한 해결책 으로 저작권법에 미분배보상금의 공익목적 사용 근거가 마련되었으며, 이미 80억원이상이 ‘공익’을 위하여 집행되었다. 그런데 대다수의 창작자들은 그 혜택을 체감하지 못하고 있다. 최근 국정감사에서는 ‘전혀 관계없는 곳에 사용’되었다는 비판에 직 면하고 말았다. 본고에서는 미분배보상금 공익목적 사용의 현황을 조사⋅분석하여 문제점을 도출하고, 해외 사례를 살펴보면서 현실적인 대안을 제시해보고자 하였다.

영문 초록

The remuneration system for the owner of author’s property rights has been actively implemented in overseas. Korea government also introduced the remuneration system of broadcasting in 1986. Since then, there have been some trials and errors and now the system is entering the settlement stage. However, ‘undistributed remunerations’ still provoke some controversy. Three remuneration collecting organizations, authorized by the Minister of Culture, Sports and Tourism, now have 42 billion and 4oo million won which has been collected but not distributed yet. The copyright act amendment in 2006 permitted to use this undistributed remunerations for which notification was made three or more years ago, but only for the public interest. Since this amendment, over 8 billion won has been executed, but the adequacy of use and procedure has often attracted criticism. The vague concept of ‘public interest’ and the institutional inertia tend to cause arbitrary decisions. This paper examines the current situation and public use of undistributed remuneration, analyses concerned problems, and shows some practical alternatives considering overseas cases.
