세종대왕이 입법한 공법(貢法)의 민주적 가치

국문 초록

현대에도 조세법의 입법은 매우 중요한 국가정책 결정이다. 따라서 조세법의 입법은 가장 민주 적인 정책결정의 방법에 의하여 국민들의 동의를 얻어 이루어진다. 조세법의 입법은 기본적으로 공청회 등 토론과정을 걸치며, 이에 따른 여론조사는 물론 정치적 협상과 타협을 걸쳐 국회에서 다수결원칙에 따라 입법된다. 본 논문에서는 공법의 입법과 시행과정에서 세종대왕이 얼마나 민주적으로 행하였는가를 고찰 하고자 한다. 세종대왕은 조세법인 공법을 입법하면서 민주시대인 현대보다도 더 민주적으로 조정(朝廷) 대신들과 토론하고, 타협하고 양보하며, 백성들의 여론을 직접 조사하고, 시범실시 하는 과정을 걸쳤다는 것이다. 그것도 부족하여 3분의 2의 가중다수결을 적용하였다. 세종대왕은 25년 이라는 긴 세월 동안 왕의 특권을 가지고 공법을 만들려고 하지 않았다. 공법을 입법하면서 백성 들의 여론을 조사하고, 시범실시를 한 것은 양반정치에서 소외된 백성들을 정치의 주체로 끌어드린 혁신적인 사건이라고 본다.

영문 초록

The legislation of taxation is a very important national policy in modern days. Therefore, the legislation of taxation is made by agreement of the public according to the most democratic policy decision method. The legislation of taxation goes through a discussion process such as public hearings, and legislate according to the majority rule in the parliament after the process of not only a public opinion poll but also political negotiation and discussion. This study considers how King Sejong has democratically performed Gongbeop and legislation during the implementation process. The first is the democratic legislative process of the court. That is, the study examines how democratically King has communicated with ministers, discussed as a debate, compromised and conceded. Second is the point that how far the public could participate in the implementation process of Gongbeop and legislation. King Sejong performed a public opinion poll and model implementation which could be seen in the democratic policy decision while legislating Gongbeop. In conclusion, King Sejong more democratically debated, compromised, conceded, directly surveyed public opinions, and implemented as a model than modern days, which is the democratic era, when legislating Gongbeop, the taxation. King Sejong did not try to make Gongbeop with the privilege of the King for long 25 years. Moreover, he excluded ‘rich get richer’ phenomenon of aristocrat bureaucrats, who were the hierarchy, and made Gongbeop to protect properties and lives of the public. This performance of public opinion poll and model implementation of public during Gongbeop legislation could be seen as an innovative event that inviting neglected public from the aristocrat politics.
