국문 초록

건국강령에 포함된 이념은 조소앙의 삼균주의였으며 그 이념은 제헌헌법에도 수렴되었다. 그 과정은 두 단계로 나뉘는데, 첫째 단계에서의 헌법초안들은 건국강령 이 담고 있었던 삼균주의를 기본 정신으로 수용하면서도 사유재산권의 보호를 조금 더 강조함으로써 건국강령 과 일정한 차이를 보이고 있다. 둘째 단계의 제헌헌법 논의에서는 유진오의 영향이 매우 컸지만 제헌국회에서의 중간파의 배제로 건국강령 의 이념이 약화되는 계기가 되었다. 제헌헌법 제정 이후에도 농지개혁을 제외하곤 그 이념을 뒷받침할 법령이 제정되지 않았으며, 결국 1954년 헌법개정으로 제헌헌법의 경제조항이 대폭 수정되면서 경제적 평등보다는 경제적 자유를 지향하는 쪽으로 변해갔다. 한국전쟁을 통한 반공이데올로기, 농지개혁을 통한 농민의 보수화 등이 이러한 과정을 부추겼으며, 내포적 공업화를 통한 경제발전의 길은 점차 더 멀어져갔다.

영문 초록

Nation－founding Program of the Korean Provisional Government in Chungching was based on three principles of the equality of Cho So Ang s Korea, and the ideology was handed to the first constitution of Republic of Korea. The enactment process of the first constitution was divided into two periods, 1946－1947 and 1948. The drafts of the first constitution suggested during the former periods accepted the three principles of the equality. However, these drafts were slightly different from Nation－founding Program in that the drafts focused on the protection of private ownership. During the latter period, the ideology of Nation－founding Program was weakened more and more due to the elimination of the centrist group in National Assembly. Eventually, the first constitution was revised in 1954 mainly around economic provisions. By the revision, the constitutional ideology was shifted from economic equality to economic freedom. This transformation was promoted by the anti－communism mode strengthened during Korean War and the trend toward conservatism of Korean peasants after Korean Land Reform.
