국문 초록

1958년 제정된 원자력법을 시작으로 원자력의 연구, 개발, 생산, 이용과 관리에 관한 법령이 제·개정과정을 거쳐 현재 원자력 관련 법령은 모두 136개가 되었다. 동 법령들은 상호 연관성이 희박한 이질적인 사항을 하나의 법률에 통합 규정함으로써, 「원자력안전법」만 하더라도 하나의 법률에 대통령령과 총리령을 제외하고도 행정기관인 원자력안전위원회가 제정한 76개의 행정규칙이 딸린, 매우 복잡하고 혼란스러운 입법체계를 유지해 왔다. 행정규칙으로써 국민을 규제함은 헌법 제37조 제2항에도 위배될 가능성을 가지고 있는바, 현재 산재되어 있거나 미비된 안전관리 규정을 추상적으로 방치할 것이 아니라 보다 구체적으로 프로세스화하여 규정할 필요가 있다. 그리고 원자력시설의 설치에서부터 운용, 폐기에 이르기까지의 손실보상에 관한 한 재산권 보장은 원자력시설의 특수성을 감안, 간접보상 및 정신적 보상까지 필요한 보상법제의 입법 방향은 현행 「전원개발촉진법」, 「전기사업법」이나 「토지보상법」의 개정 및 보완이 필요하며, 이들 법령과 별도로 개별법 내지 특별법으로서 원자력시설손실보상에관한법률을 제정하여 갈등 없는 손실보상의 객관적 기준을 제시할 필요가 있다.

영문 초록

1. CONTENTS (1) RESEARCH OBJECTIVES The purpose of this study is to build an effective management law system of safety and maintenance of nuclear facilities and complete compensation for Nuclear Plant. (2) RESEARCH METHOD The research methods are longitudinal and horizontal studies. This study compares domestic policies with foreign policies of nuclear plant. (3) RESEARCH FINDINGS After examining the current system of nuclear-related laws and regulations, we have found that safety laws related to nuclear facilities are composed of 118 legislations with 7 acts. They have lower statute of 8 Presidential Decrees, 4 Primeministrial Decrees, 2 Ministrial Decrees, 91 administrative rules(orders), 6 legislations of local self-government. 2. RESULTS For above longitudinal and horizontal study, the paper concludes that safety laws related to nuclear facilities have binding obligation regulations belonged to the exclusive authority of the national representative organization of Parliament. Even if it is inevitable to rely on the expertise of the Atomic Energy Commission, it will be right to the principle of democratic administration by referring to the opinion of the Committee, Parliament legislative form of the law would not be unconstitutional, illegal. Compensation laws stipulating fair compensation are "power development Promotion law" and "electricity Business Act." As the constitutional loss compensation for nearby residents, it is needed to provide mental loss compensation in addition to property compensation for constitutional full compensation in order to be able to guarantee their basic and environmental rights with indirect compensation.
