영문 초록

This paper is willing to suggest the logics for providing the Korean Independent Commission Against Corruption (KICAC) with the investigation rights through the international comparative study among the anti- corruption agencies of Hongkong, Singapore and Korea. In Korea there is a controversy that if the KICAC is to be given with the investigation rights, it would be helpful for curbing the corruption problems or it would stir up the overlapped burden of investigating the corruption. And so, the paper is trying to clarify the causal relations between the corruption control and the investigation rights of the anti-corruption agencies such as ICAC of Hong Kong and CPIB of Singapore, which are nowadays evaluated to be successful cases for controlling corruptions in the world. By analysing the historical data on their anti-corruption activities, the paper shows that there has been positive relation, which implies that the powerful investigation rights of the anti-corruption agencies besides the police or the prosecution could be helpful for curbing the corruptions of the country. The investigation rights have played roles of balances and checks among the organizations and have not reserved an exceptional field for corruption control. If so, can we assure that the introduction of the investigation rights for KICAC could be helpful for the corruption control in Korea? The answer is 'No'. The answer, 'No', could be changed to 'Yes', only provided that the anti- corruption agency with strong investigation rights is under operation certainly and independently in terms of personnels budgets training and so on like Hong Kong and Singapore.
