소년경찰 업무에 대한 경찰관의 의식 및 역할

국문 초록

2005년 대검찰청 범죄분석에 따르면, 지난 5년간 총 범죄율은 꾸준히 증가하고 있는 반면에 청소년 범죄는 매년 감소추세에 있고, 총 범죄 대비 청소년 범죄의 구성율은 2000년에는 6.5%였던 것이 2004년에는 3.6%에 그치고 있다. 이는 그 동안의 청소년 비행 및 범죄 예방을 위한 각종 프로그램들이 어느 정도의 실효성을 발휘한 결과로 볼 수 있다. 하지만 각종 매체들을 통해 연일 보도되는 내용을 보면 이러한 통계적 결과가 형식적이며 수치적 결과에 불과하다는 것을 잘 나타내고 있다. 과거 가정 및 학교, 지역사회의 자연스러운 통제기반이 붕괴되면서 최근의 청소년 비행 및 범죄 양상은 점차 조폭화, 집단화, 도시집중화, 누범화, 성범죄 급증의 경향으로 가고 있고, 학생범죄와 학교 폭력, 중류층 가정 출신의 청소년 범죄가 급증하고 있는 실정이다. 이러한 청소년 범죄의 죄종은 살인, 강도, 강간, 방화 등의 강력범죄로 발전하고 있고, 죄질 또한 계획적이고 지능적이며 더욱 악랄한 형태로 변모하고 있다. 특히, 청소년 범죄자들의 대부분이 재범과 누범을 경험하고 있고, 성인범으로 전이되고 있다는 점에서 그 심각성을 지적하지 않을 수 없다. 이처럼 성인범죄를 능가하는 범죄양상을 보이고 있는 청소년 범죄에 비해 이를 통제하고 관리하고 있는 소년경찰의 권한과 기능은 한정되어 있어서, 청소년보호와 범죄통제 기관으로써의 기능을 제대로 발휘하지 못하고 있다. 뿐만 아니라 전건송치주의의 규정으로 인하여 소년경찰 본연의 기능이 상실되어 있다고 해도 과언이 아니다. 따라서 이 연구는 소년경찰 업무에 대한 경찰공무원들의 의식을 설문응답을 통해 분석하여 현행 시스템이 안고 있는 문제점을 지적하고, 소년경찰 기능의 역량강화를 위한 방안을 제언하여 더욱 효과적인 소년경찰 활동이 가능하도록 하는데 목적을 두고 있다. 또한 이러한 분석결과를 토대로 비행청소년들에 대한 교정 및 교화방안과 유관기관과의 협조체제 구축방안을 제언하였고, 청소년 범죄자들에 대한 관리 및 통제방안을 제언하였다.

영문 초록

According to the 2005 crime analysis by the Supreme Prosecutors’ Office, crimes have grown steadily over the past five years, while juvenile crimes are on the decline every year. Likewise, of the nation’s total crimes, juvenile crimes represented 6.5% in 2000, and 3.6% in 2004. This trend is seen as the result of various programs working somewhat effectively to prevent juvenile delinquencies and crimes. However, everyday media reports show different results, contradicting the said statistics. As our traditional households, schools and communities are collapsing as natural control functions, recent juvenile delinquencies and crimes are gradually becoming gangster-organized, grouped, urban-concentrated, cumulative, and more related to sex. Also, crimes and violences in schools, and crimes committed by juveniles from middle class households are increasingly growing. These juvenile crimes are developing into murders, robberies, rapes, arsons and other criminal offenses, and are becoming more planned, intelligent, and crueler. In particular, most of juvenile offenders are repeaters and are becoming adult criminals, thereby raising the public’s warnings. As such, with juvenile crimes exceeding adult crimes in terms of the seriousness of offenses, juvenile police officials, who are responsible for these crimes, have limited rights and functions, thereby not properly functioning as an agency to protect juveniles and control their crimes. Also, given the regulation of forwarding all offense cases to the prosecution, the juvenile police have virtually lost their functions. In this research, police officials were surveyed about their perception of the job of juvenile police, problems surrounding the current juvenile police system were indicated, and measures were provided to bolster the functions of juvenile police to enable them to perform activities more effectively. Thus, based on these survey results, this research proposed measures aimed at correcting and guiding delinquent juveniles and boosting cooperation with related agencies. Also, measures were suggested to manage and control juvenile offenders.
