영문 초록

The army can not gain support from people without protecting human rights of the privates, whereas the army can not find justification for existence without public support. In particular, as one type of sanctions against the privates, disposition of imprisonment has been considered as typical infringement upon human rights of privates. Therefore, to eradicate the negative perception of the imprisonment, guarantee of due process should be further promoted by, for example, reducing the kinds of behaviors mandated for imprisonment, improving sentencing provision and making limited use of imprisonment disposition.
