국문 초록

본 연구는 한국과 일본에서 장애영ㆍ유아의 조기발견과 진단을 위해 어떤 법률적인 지원이 이루어지고 있는지를 비교, 분석한 것이다. 본 연구의 목적은 한국과 일본의 장애영ㆍ유아의 조기발견 및 진단에 관한 법령을 비교해 봄으로써 앞으로 법령을 제정하고 시행하는데 있어 어떤 부분이 고려되어야 하는지를 살펴보고자 하였다. 한국과 일본의 법령 비교는 장애영ㆍ유아 서 비스전달체제 및 조기발견과 진단에 초점을 두고 분석하였다. 국내에서는 장애의 조기발견을 위한 다양한 매체를 통한 홍보 방법을 비롯하여, 건강검진 실시 시기와 특수교육대상자 선정 절차 등이 구체적으로 법령에 명시되어 있었다. 반면, 일본의 경우는 건강검진의 의무화와, 장애가 의심되는 때부터 시작되는 지원과 상담, 시도교육청과 의료기관과의 긴밀한 연계에 대한 부분 등이 법령에 구체적으로 명시되어 있었다. 본 연구 결과 우리나라 법령에 있어서 장애유아의 조기발견을 위한 의뢰, 선별, 진단, 지원절차의 체계성 수립을 위한 법조항의 구체적 명시와 지역과 기관 그리고 기관과 기관과의 긴밀한 연계를 구축하기 위한 법조항이 필요하다고 본다.

영문 초록

This is a comparative study of Korean and Japanese laws on the early screening and diagnosis of children with disabilities. The main purpose of this study is co compare the pertinent laws in Korea and Japan, especially in regard co what should be considered in future Korean laws. This analysis is in the area of service delivery systems in regard to early screening and diagnosis. The procedures for the early screening of children with disabilities, the timing of health checks, and the procedures for selecting eligible special education support personnel are prescribed by Korean, but not Japanese, law, whereas mandatory health checks for young children, means of support and consultation for young children and their parent during the period when children might first exhibit a disability , and close collaboration between agents and agents for early screening and support for children with disabilities are addressed in the laws of Japan, but not those of Korea. Based on this analysis, this study demonstrates the importance of systematic coherence in screening and diagnosis, and the importance of providing support for children with disabilities, as well as well regulated collaboration between parents and agents.
