국문 초록

시장경제와 경제민주화의 상호관계에 대한 이론적 물음은 어떻게 해결될 수 있는가? 경제법규는 필연적으로 경제에 대해 독립적으로 남아 있어야 하고, 그러나 또한 한편으로 그것은 이미 물에 빠진 아이의 재생 시도가 시작되는 것과 같은 단순한 응용법학으로 축소될 수는 없으며 다른 한편으로 완전히 자명하게도 경제에 의해 분석되는 영역의 고유한 법칙성에 그 영역적 법이 주목되어야만 한다. 결국 우리 헌법은 시장경제원칙을 규정함으로서 경제시스템의 자율성(시스템이론적으로는 자동창발성)을 선언하고 있으며, 그러므로 경제시스템의 시스템환경으로서의 정치시스템과 법시스템(헌법)이 행하는 경제의 민주화를 위한“규제와 조정”은 경제시스템의 외부효과의 내부화 즉 경제의 비용으로 처리될 수 있는 범위 내에서 행해질 수 있겠다. 경제에 관한 법의 제정과 적용 및 해석은 위에 언급된 시스템이론의 범위 내에서 작동하게 될 것이다.

영문 초록

What is the right approach to solving the theoretic questions into mutual relationship between the market economy and economic democratization? Although economic laws and regulations must necessarily remain independent of economy, it cannot be reduced to simple applied legal science just like administering resuscitation on a drowning child. Rather, attention should be given to the legal principles unique in the field that can be fully and clearly analyzed by economic study. The Constitution, providing for the principle of market economy, declares the autonomy of economic system (automatic emergence, in light of systems theory) and thus both the political system as the system environment for economy and “regulation and control” for economic democracy administered by legal system (Constitution) may be implemented within the extent coverable by economic cost, which is internalization of external effect. Enactment, application and interpretation of economic laws may work within the extent of the systems theory mentioned above.
