국문 초록
자본주의의 시장경제체제에 있어서 기업의 불실화의 원인이 어디에 있던 기업의 퇴출, 인수, 합병 및 합리와 조치에 있어서 제일차적 희생자는 근로자가 될 수 밖에 없다는 것이 그 동안의 경험이었다. 소위 정리해고는 기업의 구조조정이나 합리화 조치에 있어서 가장 손쉽고도 효과적인 방법이었던 것이기 때문이다. 여기서 우리는 기업의 구조조정에 있어서 정리해고라는 하는 종래의 안일한 방법보다는 한층 적극적인 고용정책이라는 새로운 길을 모색해야 할 것이다.
영문 초록
The definition of the word, workforce reduction, means that a company cuts off or lays off the present workers in order to rearrange the personnel and to cope with economic, industrial, and technological change according to its rationalization plan.
Workforce reduction is likely to be a social problem because of the mass lay-off at the same time. It is different from that of the reprimand oriented lay-off, which is very small scale and proper reason for that.
Workforce reduction enforced by the company in case of its strained situation already has become one of major social problems in United States, Germany, and Japan and has been debated for a long time and already have been established legally and administratively.
Recently, our country facing with the IMF crisis has witnessed that the highest records of unemployment rate in the history are renewed daily. As business environments are changed extensively, workforce reduction legislation seems to be necessary to improve the competitive power of firms.
The purpose of this study is to examine the workforce reduction problem.
In many industrial countries, the workforce reduction has been a frequent topic over the discussion as an important social problem and they set up a proper system for this in order to protect workers and so, it is very influential over their national economy.
It is important for both the employer and the employee to interpret and apply the conditions for workforce reduction reasonably in this national economical crisis.
It is natural that, three parts, the government, employer, and employee feel they are responsible for a bad effect of workforce reduction, which has to be settled by a public helping-out in many industrialized countries and this trend is common t be recognized in the world.
Although the issues related to the conditions for workforce reduction are relevant to the labour law actually, the conditions for workforce reduction should be formulated conceptually with the large perspectives of employment policy, emplyment insurance, employment stabilization policy and employment training system, and should be operated under the law.
